혐오표현의 형법적 규제에 관한 비교 연구

국문 초록

최근 전 세계가 다문화사회로 변모하면서, 차별에서 비롯되는 ‘혐오표현’의 부작용이 커다란 사회문제로 대두하고 있다. 혐오표현은 단순히 대상에 대한 모욕적 언사에 그치는 것이 아니다. 혐오표현은 대상 집단, 즉 소수자와 다수의 집단갈등을 심화시키고, 사회통합을 저해함으로써 차별을 재생산한다. 대상집단의 구성원은 불안감과 공포심을 내면화하여 정당한 권리 요구를 주저하게 되며, 이는 우리 헌법의 최고 가치인 인간의 존엄성을 해치는 결과에까지 이르게 된다. 이에 본 연구에서는 UN 인종차별 철폐협약이 협약국에 혐오표현 규제 의무를 부여한다는 점을 바탕으로 미국, 영국, 독일, 일본에서 시행되고 있는 관련 입법례 및 우리나라에서 혐오표현의 규제와 관련해 발의되었던 주요 법률안에 대해 검토하였다. 그러나, 영국의 공공질서법이나 독일의 대중선동죄와 같은 형사법과 달리 미국의 민권법과 일본의 헤이트스피치해소법은 이념법에 불과하여 강제성이 미비하다는 문제가 존재하고, 한국에는 여전히 혐오표현을 대상으로 한 법률이 없음을 확인할 수 있었다. 이렇듯 궁극적으로 사회 전체에 중대한 해악을 끼치게 되는 혐오표현이 규제되어야 한다는 주장은 비단 일부의 견해가 아니라 국제기구를 비롯한 각 국가 정책과 일맥상통하나 그 규제의 형태에는 차이가 존재했다. 기존 우리 형법의 명예훼손죄와 모욕죄로는 혐오표현의 일부를 처벌할 수 있으나, 이는 개인의 사회적 평판을 저하시킬 정도의 경멸적인 표현 등에만 해당하는 것으로, 해당 표현이 혐오표현이라 처벌하는 것이 아닐 뿐더러 집단 자체를 지칭한 모욕에 대해서는 특정성이 성립하지 않아 현행법상 모욕죄로 처벌이 불가하다. 그러나 선동은 혐오표현 그 자체가 가지고 있는 해악을 배가시키는 데 효과적 행위방식이므로, 독일이나 영국의 입법례와 같이 직접적인 형사처벌조항을 통해 규율해야 할 필요가 있다. 따라서 본고에서는 혐오표현 규제방안과 관련한 국회발의안 및 독일 형법 등을 참고하여 새로운 입법방안으로서 보호법익을 공동체의 평온⸱질서로 보아 우리 형법 “제5장 공안을 해하는 죄”의 장에 이른바 ‘혐오선동죄’를 신설할 것을 제언한다.

영문 초록

Countries all over the world are becoming multicultural, and Korea is now on the threshold of a full-fledged multicultural society. Hate speech, which attacks or uses pejorative or discriminatory language with reference to a person or a group on the basis of who they are, is being regarded as serious issue that is appearing in multicultural society. Hate speech exacerbates social conflicts between minority and majority groups, and the target party internalizes fear and insecurity. With hatred and discrimination being perpetuated, hate speech undermines the fundamental rights and values upon which democratic societies are founded and causes harm not only to individual victims but also to society at large. Based on the fact that the UN Convention on the Elimination of Racial Discrimination imposes obligations on its States parties to regulate hate speech, this study reviewed relevant legislation implemented in the United States, the United Kingdom, Germany, and Japan, as well as legislative bill proposed in Korea. However, unlike UK’s Public Order Act and Germany’s Volksverhetzung (incitement to hatred), the Civil Rights Act in the US lacks effectiveness and the Hate Speech Resolution Act in Japan is merely ideological law. It was also confirmed that there is no certain law dealing with racial discrimination or hate speech in Korea. In summary, the stance that hate speech should be regulated is consistent with the policies of international organizations and various countries, but there were differences in the form of the regulation. Although it is said that some words and remarks can be punished as defamation or insult under our existing criminal code, it is only for the expressions that degrade an individual's social reputation and also fit the existing requirements, not merely because it constitutes hate speech. However, for the act of incitement doubles the harm in hate speech itself, strict legal control should be imposed through explicit criminal provisions as in Germany and UK. Therefore, in this study, we propose the establishment of a new offense, “the crime of hate incitement” under the chapter of crimes infringing public peace and order in our criminal code, referring to the legislative bill proposed in the National Assembly and German criminal code.
