양형조사에서 인공지능의 활용에 관한 시론적 고찰

국문 초록

형사사법절차에서 인공지능의 활용은 이미 제한적인 영역에서나마 현실화되고 있다. 방대한 정보처리 능력을 강점으로 하는 인공지능이 절차의 효율성을 극대화하리라는 기대가 크지만, 형사사법절차에서는 효율성 외에 인권보호와 적법절차 준수, 공정한 재판을 받을 권리의 보장과 같은 헌법적 이념의 보장이 중요한 가치이다. 따라서 형사사법의 목적과 이념에 부합하고 기여하는 범위 내에서 인공지능이 활용되어야 하며, 이를 활용하는 경우에도 예상되는 기술적·규범적 한계와 위험을 명확히인지한 상태에서 구체적 활용 방안과 보완책을 강구하는 것이 중요하다. 양형의 객관화·합리화 요청에 따라 시행된 양형조사제도는 그 필요성과 중요성에도 불구하고 여러 한계를 드러내고 있다. 조사관의 전문성이 확보되지 않아 양형의 객관화·과학화에 충실히 기여하지 못할 뿐 아니라 공정성에 대한 우려도 낳고 있다. 또한 당사자들에 대한 면담을 기본 방식으로 하면서도 인권보호를 위한 담보장치가 마련되어 있지 않다. 그런데 양형의 객관화·합리화라는 양형조사의 목적은 결국 책임원칙과 예방원리라는 형사처벌의 목적을 조화롭게 달성하기 위한 것이므로, 양형조사의 실효성을 확보하기 위해서는 형사처벌의 이념에 부합하는 양형인자의 분석과 예측이 수반되어야 한다. 이러한 문제의식을 토대로 이 글에서는 현행 양형조사제도의 문제점과 한계를 보완하고 개선할 방안으로서 인공지능의 활용 가능성을 모색해 보았다. 먼저 인공지능의 강점인 빅데이터 분석과 예측 기능을 통해 효율적으로 양형인자를 수집·분석하여 보다 객관화·과학화된 양형자료를 법관에게 제공함으로써, 현행 양형조사의 비전문성을 보완하고 합리적 양형판단에 기여할 수 있을 것으로 기대된다. 다만 인공지능의 편향성 우려를 제거하고 정확도와 신뢰도를 높이기 위해, 법관에게 양형판단의근거로 제공하기에 앞서 충분한 검증을 거쳐야 한다. 다음으로, 면담 방식의 당사자조사에서 법·심리·교정 등 전문가의 협업으로 잘 설계되고 훈련된 챗봇형 인공지능을 활용한다면, 조사자의 비전문성이나 부주의에서 비롯될 수 있는 피조사자의 인권침해를 막고 당사자의 권리를 충실히 보장하여 공정성을 확보하면서도 양형인자를 효과적으로 수집할 수 있을 것이다. 끝으로, 양형과 관련된 전문가 의견의 객관성을 검증하여 양형자료의 정확성을 제고하거나, 법관 스스로 판단의 합리성을 검증하는 사후검증 도구로 활용함으로써 양형의 과학화·합리화에 기여할 수 있을 것이다.

영문 초록

Artificial intelligence (AI) is rapidly advancing within the criminal justice system, offering significant potential to enhance efficiency through robust data processing capabilities. However, it is crucial that AI operates within a framework that upholds constitutional values such as human rights, due process, and fair trials. Therefore, integrating AI into the criminal justice system must align with its core values and objectives. Establishing clear usage protocols and safeguards is imperative, recognizing both the technical constraints and normative risks associated with AI utilization. The current investigation system for sentencing exhibits notable deficiencies. Due to a lack of expertise, the objectivity and fairness of the investigation for sentencing have yet to be fully ensured. Additionally, there is no guarantee of safeguarding the rights of defendants or victims during the hearings within the process. Given that the investigation for sentencing aims to rationalize and standardize sentencing decisions in accordance with principles of accountability and deterrence, it is essential to ensure that the assessment of sentencing factors and prediction processes align with these principles to serve justice effectively. This article explores the potential of AI to enhance the current system of the investigation for sentencing. By leveraging AI's proficiency in data analysis and predictive modeling, judges can access more objective and scientifically grounded sentencing data, facilitating informed and rational sentencing outcomes. Rigorous validation mechanisms are indispensable to address concerns regarding AI bias. Moreover, the integration of well-designed chatbot AI, developed collaboratively with legal, psychological, and correctional experts, can help mitigate human rights violations during the interview-based investigations while efficiently gathering sentencing factors and upholding the rights of all parties involved. Furthermore, AI could enhance the scientific basis of sentencing by validating the objectivity of expert opinions and reviewing judges' conclusions before the final sentencing, thereby fostering consistency and coherence in sentencing practices in line with overarching principles of criminal justice.
