기후변화에 대한 범죄학적 대응의 내용과 한계

국문 초록

기후변화에 대한 대응은 형법학자들만의 문제가 아니라 이미 오래전부터 범죄학자들의 주된 관심사가 되었다. 특히 ‘녹색범죄학(green criminology)’을 연구하는 범죄학자들이 주도가 되어 기후변화에 대한 많은 관심과 기후위기를 극복하기 위한 여러 정책적 제언들을 쏟아 냈다. 녹색범죄학자들은 기후변화 주제에 대한 연구, 정책및 실천과 관련한 우선순위를 정하여 기후위기 문제를 총체적으로 해결하고자 한다. 실제로 기후변화 문제와 관련하여 전통적 범죄학의 역할에 대해 많은 의문이 제기되고 있다. 전통적 관점에서 볼 때, 범죄학자들이 협소하게 구상한 국가안보 및 환경안보 의제를 무비판적으로 수용할 경우 범죄학은 억압적인 국가의 반환경적 혹은 기후부인을 이끄는 형사정책적 도구로 변질될 우려가 있기 때문이다. 이와 달리 기후변화 범죄학의 관점은 정반대 방향으로 향하고 있다. 기후변화 혹은 지구온난화가 인간의 작위 혹은 부작위로 인해 인위적으로 발생된 것이라면, 막대한 피해를 야기하는 기후변화 유발행위를 비록 형법상 금지행위가 아니더라도 최소한 자연범으로서 ‘범죄’로 규정해야 하며, 행위자를 특정하여 형사책임을 귀속시킬 필요가 있다. 이것이 기후변화 범죄학이 갖는 근본적인 관심사이다. 따라서 이 글에서는 기후변화에 대한 전통적 범죄학의 문제점을 간략히 살펴보았고, 이를 통해 기후변화 범죄학에서 다루는 네 가지 핵심 주제로, ① 범죄와 피해, ② 전 지구적 연결성과 생태정의, ③ 원인과 결과, 그리고 ④ 권력과 이익의 내용을 검토하였다. 또한 기후변화에 대한 범죄학적 대응으로 기후변화 관련 사회적 활동과 캠페인의 지지와 지원, 기후변화 관련 학제 간 연구와 협력, 기후과학으로서 ‘지구공학’ 관련 의사결정에의 참여, 기후변화 부인론에 대한 적극적 대처, 기후변화 관련 형사사법의 적극적 개입과 법 집행 기능 강화를 제시하였다. 이러한 논의를 바탕으로 기후위기의 시대에 기후범죄학은 인간, 환경, 동물을 착취하기보다는 이들과 공생하고 생명·생태중심적 세계관이 중심이 되는 미래를 위한 토대를 만드는 데 기여해야 함을 결론으로 도출하였다.

영문 초록

Response to climate change is not just a problem for criminal law scholars; it has already been a major concern of criminologists for a long time. In particular, green criminology presents several policy suggestions to overcome the climate crisis. Green criminology seeks to holistically solve the climate crisis problem by setting priorities related to research, policy, and practice on the topic of climate change. In fact, many questions are being raised about the role of traditional criminology in relation to climate change issues. From a traditional point of view, if criminologists uncritically accept the narrowly conceived national security and environmental security agenda, there is a risk that criminology will be transformed into an anti-environmental tool of the state or a criminal policy tool leading to climate denial. In contrast, the perspective of climate change criminology is heading in the opposite direction. If climate change or global warming is artificially caused by human actions or omissions, acts causing climate change that cause enormous damage should be defined as at least an original ‘crimes’, even if they are not prohibited under criminal law. And it is necessary to identify the actor and attribute criminal responsibility. This is a fundamental concern of climate change criminology. Therefore, this article briefly examines the problems of traditional criminology regarding climate change, and through this, reviews the four key topics covered in climate change criminology: ① crime and damage, ② global connectivity and ecological justice, ③ causes and effects, and ④ power and interests. It also suggests, as a criminological response to climate change, sponsorship and support for climate change-related social activities and campaigns, interdisciplinary research and cooperation related to climate change, participation in decision-making related to ‘geoengineering’ as climate science, active response to climate change denialism, and active intervention in criminal justice related to climate change and strengthening of law enforcement functions. Based on these discussions, it is concluded that in the era of climate crisis, climate criminology should contribute to creating a foundation for a future that coexists with humans, the environment, and animals rather than exploit them, and centers on a life-and ecological worldview.
