국문 초록

전 세계적으로 에너지 전환을 기반으로 탄소 중립 및 친환경 지향을 위한 움직임이 다양하게 이어지는 가운데 여전히 석유 등의 자원은 중요한 자리를 차지하고 있다. 그러한 상황에서 법제는 적절한 관리와 대비를 위한 기본제도 마련에서 중요한 사항이다. 한국 법제는 일제강점기 법제로부터 영향을 받은 사항이 상당하다. 일제는 지난날 식민지 조선의 인적·물적인 다양한 수탈을 법제를 바탕으로 하였다. 이는 우리의 뼈아픈 과거이자 잊을 수 없는 역사이기도 하다. 그러한 까닭 등으로 한국과 일본의 경우 행정체계와 법체계가 상당히 유사한 부분이 많다고 볼 수 있다. 따라서 법제의 역사적인 검토를 바탕으로 광업법 관련의 역사적·법제적 시사점의 고민과 생각의 환기를 시도해 볼 필요가 있다. 아픈 역사이지만 그 속에서만 살아갈 수 없는 것이 현실이다. 이에 현재 우리에게 참고될 만한 사항을 선별하고 보다 상생할 수 있는 다양한 시각에서의 논점을 생각해 볼 필요가 있다. 결국 현실적인 측면에서 전 세계적으로 자원 관련 상황이 변화하고 있는 속에서 新 광물자원 등의 효율화 등을 도모하는 관점에서 지속적인 검토 및 논의를 바탕으로 한국의 자원을 보다 유용하게 할 수 있도록 하여야 한다.

영문 초록

Various movements for carbon neutrality and eco-friendliness are proceeding globally grounded on the conversion of energy; however, resources like oil still occupy an important position. In this situation, legislation is an important issue in the preparation of the basic system to manage and cope with it properly. Korean legislation has been significantly influenced by the law in the Japanese colonial era. Japanese colonial rule was based on the legislation to exploit labor and material from colonial Joseon in many ways then. This is our painful and unforgettable history. For this reason or such, there are quite a lot of similar parts between Korea and Japan in terms of the administrative system and the legal system. Therefore, based on the historical review of the legislation, it is necessary to attempt to consider and contemplate historical and legal implications related to the Mining Law. It was such a painful history, but we should not keep living in it. Therefore, it is needed for us to select the items that can be referred to now and think about the issues from various perspectives for mutual survival. In conclusion, from realistic perspectives, it is necessary to examine and discuss it constantly to make new mineral resources efficient within the conditions related to resources changing globally and utilize Korean resources more usefully.
