EU의 탄소중립을 위한 폐기물과 순환경제에 관한 법정책적 검토를 통한 한국의 입법과 순환경제 정책에의 함의

국문 초록

현재 국제사회는 기후위기 과제의 해결을 위하여 2050년 탄소중립 실현을 위한 법정책적노력을 지속하고 있다. 우리나라도 2015년 파리협정(Paris Agreement)에 따른 국가적 의무이행을 위하여 탄소중립 실현을 위한 국가전략 및 국가기본계획을 수립하고 있다. 본 연구는이러한 차원에서 EU 폐기물 지침과 순환경제를 향한 제도적인 노력을 분석하고, 제도 및 기술개발을 통해 탄소중립의 실현에 기여할 수 있는 방향성을 수립하기 위해 EU의 폐기물관련법과 정책, 그리고 EU의 순환경제 지향을 위한 정책 등에 대하여 분석하였다. 연구결과, EU 는 폐기물 기본 지침을 중심으로 여러 가지 폐기물과 관련된 지침 및 규정들을 마련하였다. 폐기물의 운송, 처리 작업, 회수 등 물류와 관련된 규정들이 정책 필요에 의해 제·개정되었다. 특히 EU 폐기물 기본지침은 순환경제로의 전환에 대한 고려가 목적조항에서부터 명시되어있고, 재활용에 대한 목표와 회수의무 등이 개정을 통해 강조되고 있다. 무엇보다도 EU는 폐기물의 처리 작업에 있어 인간건강·환경보호에 더욱 집중하고 있다. 한편 탄소중립 및 순환경제를 위한 최근의 EU 탄소중립산업법은 전략적 넷제로 기술에 관련한 산업지원의 내용을 담고 있으며, 전략적 넷제로 기술 중 배터리 기술을 강조하고 있다. 향후 EU는 순환경제 조치를 기반으로 하면서 유럽 그린딜이 요구하는 변혁적 변화를 가속화하며 합리적인 규제 프레임워크를 제도화하는 과정이 필요한 것으로 보인다. 구체적으로 EU는 폐기물 매립에 대한 재활용 및 회수 목표가 제시되어있지만 미달성시의 패널티가 부족한 면은 개선되어야 할 것으로 보인다. 다음으로 폐기물 관련 지침의 '적합도 검사'상 폐배터리 관련 지침의 환경, 안전고려와 폐기물 수출, 반출시 국제공조 및 비EU회원국과의 협력에 대한 필요성도 강조되어야할 것으로 보인다. EU의 폐기물과 순환경제에 대한 법정책에 대한 연구결과, 한국에서도 국가표준화를 통해 충전기 절약 및 비용저감을 통한 순환경제 정책 목표 도달에 이를 수 있을것이라는 시사점을 얻었다. 다음으로 사용 후 폐배터리에 대한 통합법제가 필요하고 유럽연합의 단계적인 규제 정책과 목표설정의 달성과정을 참고한 정책 집행이 되어야 함을 알 수있었다. 마지막으로, 대체로 폐기물의 처리에 집중된 순환경제 정책을 전사이클에 걸친 시각변화가 필요했고, 소비자, 지역주민 참여형 순환경제가 부각되어야 함을 알 수 있다.

영문 초록

Legal policy efforts are continuing to realize carbon neutrality in 2050 to solve the climate crisis challenges. Korea established a national strategy and national basic plan to realize carbon neutrality to fulfill its national target under the 2015 Paris Agreement. In this regard, this paper analyzed the EU's waste-related bills and policies, and the EU's policies for the circular economy to analyze institutional efforts toward EU waste guidelines and circular economy. As a result, there are various guidelines and regulations related to waste in the EU. Regulations related to logistics, such as transportation, disposal, and recovery of waste, are being revised according to policy needs. In particular, the EU Waste Basic Guidelines stipulated the consideration of the transition to a circular economy from the purpose clause. And the goals and recovery obligations for recycling are emphasized through the revision. In particular, it is focusing more on human health and environmental protection in the treatment of waste. In particular, the EU's Carbon Neutral Industry Act contains industrial support related to strategic net-zero technology and emphasizes battery technology among strategic technologies. In the future, the EU will need to accelerate the transformational changes required by the European Green Deal and institutionalize a reasonable regulatory framework, based on circular economic measures. Specifically, the EU proposed recycling and recovery targets for waste landfill, but the lack of penalties in case of failure is expected to be improved. Next, the 'Fitness Inspection' of the waste-related guidelines also emphasizes the need for environmental, safety considerations and waste export and cooperation with non-EU member states in the waste battery-related guidelines. As a result of a study on the EU's legal policy on waste and the circular economy, it was suggested that Korea will be able to reach its circular economy policy goal by saving chargers and reducing costs through national standardization. Next, it can be seen that an integrated legislation for spent batteries is needed and that the policy should be implemented by referring to the step-by-step regulatory policy of the European Union and the process of achieving goals. Finally, it can be seen that the circular economy policy, which is usually concentrated on the disposal of waste, needs to be changed throughout the cycle, and the circular economy.
