부동산중개보조원제도의 개선방향에 관한 연구

국문 초록

본 연구의 목적은 우리나라 부동산중개보조원제도의 실태를 조사·분석하고, 실증분석을 실시하여 문제점을 도출한 후, 도출된 문제점을 효율적으로 해결하기 위한 개선방향을 제시하는 것이었다. 연구 결과, 본 연구에서는 현행 부동산중개보조원제도에 관하여 신고과정, 업무수행과정 및 지도·감독과정으로 구분하여 문제점을 도출하였으며, 이상의 문제점을 토대로 개선방향을 제시하면 첫째, 중개보조원의 신고과정에서는 직무교육을 6시간 이상 9시간 이하로 확대하고, 교육내용에도 ‘부동산중개 관련 법령’과 ‘부동산중개 실무’를 추가하며, 교육방식도 직접교육방식으로 전환함으로써, 최소한의 전문성을 강화할 필요가 있었고 둘째, 중개보조원의 업무수행과정에서는 중개보조원에 관하여 ｢공인중개사법｣ 제15조에서 중개보조원의 업무 유형을 열거하고, 이를 위반하였을 경우에는 고용인에게 벌칙을 부과하는 규정을 마련할 필요가 있었으며 셋째, 중개보조원에 대한 지도·감독과정에서는 중개보조원의 불법행위 단속을 위한 등록관청의 주기적 관리의무를 규정화할 필요가 있었다.

영문 초록

The purpose of this study was to draw up problems of the the real estate brokerage assistant system by examining and analyzing the current conditions of it in Korea and suggest an improvement directions of it to efficiently resolving those drawn. From the findings, it drew out the problems, by dividing the current real estate brokerage assistant system into reporting, service providing and instruction·superintendence process, and provided the following improvement directions based on the problems First, it was necessary to enhance the minimal expertise, by extending the time for the on-the-job education up to 6-9 hours, adding the ‘law on real estate brokerage’ and the ‘real estate brokerage practice’ to the curriculum and converting the existing teaching method into the direct one in the reporting process of brokerage assistants. Second, it was necessary to make the rule that requires the article 15 of the ｢Real Estate Agent Act｣ to list the types of brokerage assistants tasks and fines them for violating the act, in the service providing process of brokerage assistants. Third, it was necessary to regulate registration offices’ responsibility for the periodic supervision to control brokerage assistants’ illegal activities.
