주택특별공급제도의 문제점과 개선방안

국문 초록

주거문제를 해결하기 위해 우리나라는 주택의 양적 공급을 목적으로 하여 관련법체계를 제정하고 제도를 시행하였다. 그러나 주거문제의 심각성과 사회 환경의 변화에 따라 주거 정책의 패러다임을 주택의 양적 공급 확대에서 주거복지로 전환하고, 2015년 주거기본법을 제정하여 이를 최상위법 및 기본법적 지위에 두어법체계와 제도의 변화를 이끌고자 하였다. 그러나 주거기본법이 제정되고 주거권이 규정됨과 더불어 주거 또한 사회 보장법의 영역에서 논의되어야 할 필요성에도 불구하고, 주거관련법제도들은 여전히 정치·정책적 관점에서 논의되고 있다. 주거복지의 실현 방법으로 주택의 공급제도 중하나인 주택특별 공급제도의 경우, 사회적·정책적 배려대상자를 위한 주택공급 방식으로, 사회 보장법의 관점에서 더욱 치밀하게 논의될 필요가 있다. 따라서 법치국가 원리및 사회 국가 원리에 따라 특별 공급제도를 검토해볼 필요가 있다. 그러나 특별 공급제도는 대상자및 유형, 요건등이 복잡하게 규정되어 있으며, 대상자에 대한 정의 규정도 없다. 뚜렷한 원리나 규범이 존재하지 않은 채 법이 규정되고 제도가 시행된다면 국민의 주거권 보장에다가갈수없게 된다. 따라서 실질적 주거권 보장을 위하여 주거복지 및 사회 보장법의 관점에서 주택특별 공급제도를 해석하고 개선할 필요가 있다.

영문 초록

In order to solve the housing problem, Korea enacted a related legal system and implemented a system for the purpose of quantitative supply of housing. However, according to the seriousness of the housing problem and changes in the social environment, the paradigm of housing policy was changed from expanding the quantitative supply of housing to housing welfare, and the “Framework Act On Residence” was enacted in 2015. However, with the enactment of the “Framework Act On Residence” and the provision of housing rights, despite the need for housing to be discussed in the field of social security jurisprudence, housing-related legal systems are still being discussed from a political and policy perspective. In the case of the special supply system of housing, one of the housing supply systems as a method of realizing housing welfare, it needs to be discussed more closely from the perspective of the social security jurisprudence because it is a housing supply method for social and policy considerations. Therefore, it is necessary to review the special supply system of housing according to the principle of the rule of law and the principle of the social state. However, the special supply system of housing has complex regulations on the subject, type, and requirements, and there is no definition of the subject. If the law is defined and the system is implemented without clear principles or norms, it will be impossible to accomplish the guarantee of the people's housing rights. Therefore, it is necessary to interpret and improve the system from the perspective of the housing welfare and social security jurisprudence to guarantee actual housing rights.
