중독범죄자의 사회복귀 활성화 방안 -치료조건부 가석방제도의 도입을 중심으로

국문 초록

중독이라는 현상이 범죄를 증가시키는 요인으로 작용하게 되는 중독범죄는 범죄자에 대한 처벌보다 치료 및 재활 중심의 정책이나 제도의 실행으로 이들의 원활한 사회복귀를 돕는 것이 중요하다. 국내에서는 심신장애 상태, 마약류·알코올이나 그 밖의 약물중독 상태, 정신성적 장애가 있는 상태 등에서 범죄행위를 한 자로서 재범의 위험성이 있고 특수한교육·개선 및 치료가 필요하다고 인정되는 자를 치료감호시설에 수용하여 치료를받게 하는 치료감호제도의 운영을 확대하고 있고, 마약류 중독범죄자에 대한 치료보호 조건부 가석방제도나 도박 중독범죄자에 대한 각종 치료센터의 운영, 성범죄자에 대한 약물치료나 교정심리치료를 실시하는 등 개별 중독범죄에 맞는 치료 및 재활프로그램의 개발과 운영을 위해 많은 노력을 기울이고 있다. 그러나 치료감호소는 중독범죄자의 증가로 인한 수용과밀화 문제가 발생하고, 치료 및 재활프로그램의 대상자 선정에 대한 제한과 그 기준의 엄격함, 전문 인력의 부족 등으로 중독범죄자에 대한 사후치료와 관리가 어렵게 되면서 중독범죄의발생과 범죄자의 재범률이 지속적으로 증가하고 있는 추세이다. 이러한 문제들을먼저 인식한 독일이나 미국 등에서는 사회 내 치료프로그램에 일반적인 집행유예대상자 이외에도 가석방자, 특수보호관찰자 등을 포함시켜 사후치료를 제공함으로써 범죄자의 출소 후에도 재범을 방지하기 위해 노력하고 있다. 이 연구에서는 중독범죄자의 원활한 사회복귀를 위해 교정시설 내에서 기초단계의 치료를 시행한 후 대상자의 갱생의지를 파악하여 일정요건이 충족되면 민간 전문치료시설에서 사회복귀를 위한 치료 및 재활을 받을 수 있도록 가석방을 허가해 주는 ‘치료조건부 가석방제도’의 도입을 제안하였다. 물론 제도의 도입에 앞서 관련 법 규정의 정비, 전담부서의 설치, 치료기관 및 전문 인력의 확충 등이반드시 병행되어야 할 것이다.

영문 초록

Addiction increases crimes, and importantly, addiction crimes should be reduced by helping the criminals return to normal social life by implementing treatment and rehabilitation policies instead of punishing them. At home, many efforts are being made to develop and implement treatment and rehabilitation programs - including the expansion of the treatment and custody system of Institute of Forensic Psychiatry, the system of temporary release of drug-addicted criminals on condition of treatment, the operation of various treatment centers for gambling addicts, and medication treatment and psychological treatment for sex criminals - for those who commit crimes in the narcotic or alcohol or other drug addiction state or due to psychological disorders, who have the danger of re-committing crimes, and who need to receive special education and treatment. But, Institute of Forensic Psychiatry cannot accommodate all the increasing addiction criminals, should selectively choose targets of treatment and rehabilitation programs with strict criteria, and suffer from a lack of professional manpower. They have difficulty following up on the treatment of individual addiction criminals, leading addiction crimes and the criminals' re-committing rate to continue to increase. Germany, the US, and other developed nations, aware of the seriousness of these crimes, are providing follow-up treatment services, targeting criminals on suspended sentence, the released criminals on parole, and criminals under the special protection and observation, under social treatment programs, in a bid to prevent criminals from re-committing crimes after being freed from prisons. This study proposed ‘The Treatment Conditional Parole System’ by which, after addiction criminals are given basic treatment at correctional establishments, they, if meeting certain conditions, are released on parole to receive treatment at private special treatment facilities to return to normal social life successfully. Along with the introduction of the proposed system, relevant laws should be amended, specialist departments should be established, and treatment facilities and professional manpower should be expanded.
