‘배심원 선정 담화’에 대한 배심원 후보자의 인식

국문 초록

목적: 국민참여재판 배심원 선정 과정에서 이루어지는 법조인과 배심원 후보자 간의 질문과 답변을 ‘배심원 선정 담화’로 규정한 후, 이를 경험한 배심원 후보자들이 이 새로운 담화의 수행 방식에 대하여 어떻게 인식하는지를 고찰하였다. 방법: 법원의 ‘배심원 선정 담화’ 참관이 불허된 사유로, 차선책으로서 배심원 후보자들이 담화에 참여한 이후 작성한 후기를 연구 자료로 활용하였다. 자료 분석을 위해서 법률에 명시된 배심원 선정 담화의 수행 방식과 Gee(2015)의 담론 이론을 참조하여 분석의 기준을 설정하였다. 결과: 배심원 후보자들은 법률에 근거한 ‘이차 담론’과 실제 담화 수행 사이에 간극이 있음을 인식하고, 명시적인 이유 없이 최종 배심원단에서 탈락되는 과정에서 이를 모면하기 위하여 그들 고유의 담화 수행 방식, 즉 또 다른 담론을 형성하였다. 결론: 이때의 담론은 배심원 선정 담화라는 새로운 담화 유형에 대한 일반 시민들의 문제의식의 소산이라고 할 수 있다. 그러나 이와 동시에 해당 담화의 본래 목적을 염두에 둘 때 이는 부분적으로 윤리적인 측면에서 재고의 여지가 있다.

영문 초록

Purpose: In this study, questions and answers between lawyers and jury candidates in the process of selecting jurors for public participation trials were called jury selection discourse. And how the general public candidates who participated in this perceived the new discourse called the jury selection discourse was investigated. Methods: As the reason that court observation of the jury selection discourse was not permitted, as a sub-optimal measure, reviews written by jury candidates after participating in the discourse were used as research material. This was analyzed using the method of conducting discourse based on the law as the analysis standard. More specifically, based on Gee (2015)’s point of view, after viewing the method as a ‘secondary discourse’ that dominates the field of jury selection discourse, we analyzed how candidates perceive it in the process of jury discourse. Results: The jury candidates recognized that there was a gap between the legal ‘secondary discourse’ and the actual discourse performance. In particular, in order to avoid the process of being eliminated from the final jury for no explicit reason, they formed their own way of conducting discourse, another discourse. Conclusion: The jury selection discourse being generated in the jury selection discourse can be seen as a product of the candidates' active awareness of the new type of discourse. However, it should be noted that there is room for ethical reconsideration given the original purpose of the discourse.
