경미범죄 감경제도의 실태 및 개선방안에 관한 연구

국문 초록

본 연구는 경찰 단계에서 경미한 범죄에 대한 처리 절차상 회복적 사법을 적용하여 범죄행위로 인한 다양한 갈등과 문제해결을 위한 개선방안을 제시하기 위한 목적의 연구이다. 현재의 경찰 단계에서 경미 범죄에 대한 대응 방식의 문제점과 한계상황에 대한 진단을 통하여 회복적 사법을 알맞게 적용하기 위한 조직구성원들의 사물을 분별하고 판단하는 인식 제고와 공감대 확산 및 회복적 사법제도 적용을 위한 경찰조직과 운영체계의 정비가 우선 되어야 한다. 즉결심판 제도에 대한 효율적 활용에 있어 경찰의 단계에서 경미 범죄에 대한 즉결심판 청구나 훈방권 행사가 적극적으로 이루어지지 못하는 현실을 감안하면, 경미범죄에 대한 즉결심판 절차법에 따른 훈방처분이나 형사입건을 경찰의 감경 처분으로 즉결심판을 청구할 수 있는 근거 규정의 정비가 이루어져야 한다. 이러한 명확한 법적 규정에 의하여 경찰 단계에서 경미범죄 사건을 종결 처리할 수 있는 즉결심판 청구와 훈방처분의 활성화가 필요하다. 지역사회의 실질적인 참여를 위해서 지역 경찰과 사건 관계자뿐만 아니라, 지역사회가 골고루 참여하여 서로 의견과 필요한 정보를 교환하고 무엇보다 중요한 같은 범죄가 일어나지 않도록 예방과 억제를 통해 불안감을 없앨 수 있는 실질적 경찰활동 프로그램이 개발되어야 한다.

영문 초록

The purpose of this study is to present improvement measures for solving various conflicts and problems caused by criminal acts by applying restorative justice in the process of handling minor crimes at the police level. At the current police stage, it is necessary to improve the awareness of identifying and judging objects of members to properly apply restorative justice through diagnosis of problems and limitations in responding to minor crimes, spread consensus, and improve the police organization and operating system. Considering the fact that the police are not actively seeking summary judgment or exercising the right to discipline minor crimes at the police stage in efficient use of the summary judgment system, it is necessary to reorganize the grounds for requesting summary judgment through police mitigation. In accordance with these clear legal regulations, it is necessary to activate the request for summary judgment and disciplinary action that can terminate minor crime cases at the police stage. For the actual participation of the community, not only local police and incident officials, but also local communities should participate evenly to exchange opinions and necessary information, and most importantly, to eliminate anxiety by preventing and suppressing the same crime.
