항행선박의 연안 고정식 부유물과의 해양사고에 대한 고찰

국문 초록

어구와 어법의 종류는 다양하지만, 중앙해양안전심판원 재결서에 따르면 항행하는 선박과 충돌하여 발생하는 어구 손괴 사고는 자망류, 정치망류, 통발류, 양식장 등이 있으며, 이러한 사고의 원인으로 항해 중인 선박의 항행 중 경계 소홀과 항행계획 미수립, 조선 미숙 등이 주원인이었으며, 야간에 발생하는 사고는 야간항해 시 육안을 통한 경계 중 양식장이나 어장에서 설치된 야간표지를 발견하기 어렵거나, 야간표지를 설치하지 않는 어구들로 인해 사고가 발생하는 것을 알 수 있었다. ｢어업의 허가 및 신고 등에 관한 규칙｣ 제13조 별표[8]에 따르면 연안어업과 관련한 어업에서 연안개량안강망어업, 연안통발어업, 연안자망어업은 어구를 부설한 때에는 어구마다 어구의 위치를 표시한 부표(부자)나 깃대에 관한 규정과 설치해야 하는 표지의 크기와 허가 어선의 제반 사항이 명시되어 있으나, 부표(부자) 또는 깃대의 크기에 관련 기준과 야간표지에 관한 규정은 명시되어 있지 않다. 또한, ｢양식장·어장 표지시설의 설치 기준｣제4조(설치방법 및 기준) 제1항은 양식장이나 어장의 양식장 및 어장을 식별할 수 있는 부자의 크기, 설치방법과 야간에도 어장을 확인할 수 있는 빛을 반사하는 효과의 부자를 설치하여야 한다고 명시되어 있지만, 빛을 반사하는 반사판은 항해하는 선박이 어구가 설치된 해역을 통과할 때 선박에서 양식장이나 어구를 확인하기 위해 서치라이트와 같은 불빛을 비추거나 주위 불빛과 같은 빛을 받아 반사판에서 빛을 반사하여 주위 설치된 어구의 존재를 알려줄 수 있다. 반사판과 같은 야간표지가 없는 야간에 보편적으로 설치된 어구를 확인하는 가장 일반적인 방법은 레이더 장비를 활용하는 것이다. 이러한 레이더 장비 또한 기상 상황에 따라 레이더를 통한 어구 발견이 어려운 상황이 발생하여, 육안으로도 야간에 어구를 확인할 수 있는 방안을 어구부표에 설치하는 야간표지 설치방법을 현행법령 개정을 통해 개선해 보고자 한다.

영문 초록

Although there are various types of fishing gear and fishing methods, according to the ruling of the Central Maritime Safety Tribunal, there are gill nets, pole nets, traps, and aquaculture farms. It was found that the main causes were neglect of vigilance during the voyage, the incomplete navigation plan, and the inexperience of shipbuilding. Accidents occur due to the negligence of vigilance through the naked eye without using radar equipment during night voyages of ships or negligence during navigation. In the attached table [8] of Article 13 of the ｢Rules on Permission and Reporting, etc. of Fishing Fishery｣, in case of fishing related to coastal fishery, the location of fishing gear is indicated for each fishing gear when fishing gear is installed for coastal improved angling net fishing, offshore trap fishing, or offshore gill net fishing Regulations on one buoy (buoy) or flagpole, the size of the sign to be installed, and all matters of licensed fishing boats are specified, but the relevant standards and regulations regarding the size of the buoy (buoy) or flagpole are not specified. . In addition, Paragraph 1 of Article 4 (Installation method and standard) of ｢Standards for installation of aquaculture and fishery facility sign facilities｣ refers to the size, installation method, and light that can identify the fishery at night Although it is specified that a buoy with the effect of reflecting the light should be installed, the light reflecting plate illuminates a light such as a searchlight or ambient light to check the fish farm or fishing gear from the vessel when the sailing vessel passes through the water area where the fishing gear is installed. It can receive the same light and reflect the light from the reflector to inform the existence of the fishing gear installed around it. The most common way to check installed gear at night in a situation is to use radar equipment. The purpose of this study is to find a way to improve the method of installing fishing gear signs in situations where it is difficult to find fishing gear through radar due to the influence of the weather environment or to check fishing gear with the naked eye at night.
