『조선경국전』의 조세개념과 조세제도에 관한 연구

국문 초록

조선의 건국 주체는 집권적 국가 운영체제를 확립하기 위해서 법체계를 수립하려고 하였다. 이에 조선왕조는 다양한 분야에서 수많은 법제도를 만들고 잘 완비된 법에 의해 통치한 사회인데 그 시작은 태조 3년(1394년) 정도전이 편찬한 『조선경국전(朝鮮經國典)』부터이다. 『조선경국전』은 정도전의 사찬(私撰)으로 조선왕조가 재정한 법전은 아니지만 조선조의 최초 헌법이라고 할 수 있으며, 훗날 『경제육전』과 『경국대전』의 편찬에 큰 영향을 미쳤다. 『조선경국전』 부전 총서조를 요약하면 “부(賦)란 국가재정 즉, 국가 및 국방의 수요를 총칭하는 말로서 백성으로부터 수취하는 전곡(錢穀)이며, 부세(賦稅)란 백성으로부터 수취하는 일체의 조세이다”라고 할 수 있다. 여기서 조세를 뜻하는 조선 초기 단어는 부세(賦稅)이고, “부세는 국방 및 국가의 재정수요의 충당을 위하여 백성들이 바치는 전곡(錢穀)이다”라고 정의를 할 수 있다. 이는 현대의 일반적인 조세정의인 “조세란 국가나 공공단체가 그의 일반적인 경비를 충당하기 위해 그 구성원으로부터 강제적으로 징수하는 재화이다’와 매우 유사한 것이다. 그리고 『조선경국전』의 부세조(賦稅條)에서는 “옛날 성인(聖人)이 부세법(賦稅法)을 만든 것은 다만 백성으로부터 수취하여 자기를 봉양하자는 것은 아니었다. 백성들이 서로 모여 살게 되면 음식과 의복에 대한 물욕 때문에 외부에서 공격하고, 남녀에 관한 정욕은 내부에서 공격한다. 미움(醜)이 있으니 서로 다투게 되고, 힘으로 겨루니 싸우게 되어 서로 죽이기까지 하는 것이다. 통치자는 법을 가지고 그들을 다스려서 다투는 자와 싸우는 자를 평화롭게 해 주어야만 민생이 편안해지는 것이다. 그러나 그 일은 농사를 지으면서 병행할 수 없는 것이므로 백성은 10분의 1을 세로 바쳐서 통치자를 봉양하는 것이다. 통치자가 백성으로부터 수취하는 것이 큰 만큼, 자기를 봉양해 주는 백성에 대한 보답도 역시 중한 것이다.”라고 규정하여 조세근거를 제시하고 있다. 정도전이 『조선경국전』 부전 부세조를 통하여 준 메시지는 조세의 근원적인 특성은 ‘조세를 통한 편안한 백성들의 삶’을 강구하는 것이다. 이는 현재 조세법을 입법하고 집행하는 사람뿐만 아니라 세무학을 연구하는 모두에게도 지금도 유익한 원칙이라고 본다. 본 논문은 『조선경국전』에 규정되어 있는 이러한 ‘조세의 정의’와 ‘조세의 근거’ 등을 분석하고, ‘조세체계’와 그 내용을 살펴봄으로써 조선시대의 조세법제사에 대한 이해의 폭을 넓히고, 체계화하는데 기여하고자 한다.

영문 초록

Joseon Gyeonggukjeon was compiled by Jeong Do－jeon in the third year of the king Taejo. Chongseo article in Bujeon of Joseon Gyeonggukjeon can be summarized as the following. ‘Bu (賦) is a word that generally calls national finance, which is demand of nation and national defense. It is Jeongok(錢穀, money and grain) collected from the people. Buse(賦稅) means offering Bu(賦).’ The early word in Joseon Dynasty for taxation is Buse(賦稅) and it can be defined as the following. ‘Buse(賦稅) is Jeongok(錢穀, money and grain) that the people offer for covering financial demand of nation and national defense.’ This is very similar to a general modern definition of taxation, ‘taxation is goods that is forcefully collected from the members of country of public organization in order to cover general expenses.’ On article Buse(賦稅條) of Joseon Gyeonggukjeon suggests grounds of taxation as defining as the following. ‘The reason that holy men made Busebeop(賦稅法, taxation institution) was not to support themselves by collecting from the people. When people live close to each other, they were attacked from exterior due to greed for food and clothing and from interior due to sexual desire of men and women. Hatred leads to fights, and fights lead to killing. The ruler must control them with laws for peaceful livelihoods of the public. But this task cannot be handled along with farm work, so the people offer 1/10 of their income as tax to support the ruler. As the ruler receives a lot from the people, it is also important to give back to the people who support him.’ The message that Jeong Do－jeon gives through article Buse(賦稅條) in Bujeon of Joseon Gyeonggukjeon that the fundamental characteristic of taxation is pursuing ‘happy and comfortable life through taxation.’ This is a good principle for not only the person who legalizes and executes taxation law but also everyone who studies tax science. This research analyzes ‘definition of taxation’ and ‘basis of taxation,’ which are defined on Joseon Gyeonggukjeon and contributes to broadening and systemizing the understanding on the history of taxation in the Joseon Dynasty by studying its ‘system of taxation’ and its content.
