국문 초록

중국에 진출해 있는 한국의 많은 기업들은 한국과 중국의 상이한 회계 관행이나 세법으로 인해 경영에 상당한 애로사항이 있다. 이 글은 세무조사에서 적출된 사례들을 분석하여 유형화하여 그 원인과 대책을 제시하였다. 회계처리와 세법의 미숙지, 상이한 경영환경, 현지의 세무대리인에 의한 잘못으로 인하여 본의 아니게 세무조사에서 적출당하는 경우가 많았으나 대부분 세무대리인의 적절한 조력을 얻고 있지 못하고 있는 실정이다. 대책으로는 양국의 차이에 대한 교육과 전문 세무대리인의 육성이 시급하며, 국가적 차원에서 이 분야에 대한 정기적이고 보다 상세한 정보와 자료의 제공이 필요하고, 관리자에 관한 연수의 기회가 주어져야 한다. 이전가격의 경우는, 과세당국의 과세방침에 맞추어 증빙과 자료를 충분히 준비하는 것이 필요하다.

영문 초록

Many Korean Companies that has advanced into China have some bottlenecks in business management because of the differences in tax laws and accounting between Korea and China. This article presents the reasons and counter-plans of analyzed and classified cases found at tax inspections in china. Many parts tend to show similar points with the cases in Korea but there are so many different cases that was found at tax inspections. The principal results was caused by differences of accounting principles of China, unskillfulness of the chinese tax laws and business environments. For counterplans, it is necessary not only to educate the persons that are charge of accounting and tax in China but also to offer enough informations about chinese tax policies. And companies located in China should give up the inadequate way in solving problems depending on human relationship(GUANXI) instead of laws and principles. The most important thing is that companies are effort to keep the tax laws and accounting princples.
