전통문화유산의 계승･발전 및 세계화의 헌법적 정당성에 관한 소고

국문 초록

이 글은 우리 전통문화유산의 계승･발전과 세계화에 대한 국가적 노력을 헌법적인 관점에서 평가해 보고자 시도된 것이다. 전통문화유산의 발굴과 보존 및 새로운 가치의 창출을 위해서는 국가의 역할이 특히 강조된다고 할 수 있다. 우리나라는 현재 15개의 유네스코 등재 세계 유산이 있다. 이러한 세계 유산은 우리 국민들의 소중한 문화적･자연적 자산일 뿐만 아니라 세계적 시민들에게도 매우 큰 영향력을 가진 귀한 자산이다. 국가, 특히 문화재청은 유네스코 등재를 위하여 다방면으로 여러 노력을 경주하고 있는데 이러한 노력의 결실로 우리나라가 세계적인 자연 및 문화유산을 보유한 나라가 되었다. 우리의 전통문화유산이 국가와 민간 부문의 다양한 노력을 통하여 유네스코 세계유산 목록에 등재된다면, 전 세계인의 문화향유의 대상이 되어 우리 전통문화유산의 세계화를 실현하게 되는 것이다. 이러한 국가의 노력은 헌법 제9조에 근거를 둔 민족문화창달을 위한 국가의 역할을 잘 보여주는 단면이라고 할 수 있다. 이에 더하여 이러한 국가적 노력이 문화기본권과의 관계에서 어떠한 정당성을 갖는지에 대해서도 살펴 살펴보기로 한다. 문화기본권의 자유권적 성격과 사회권적 성격을 함께 강조한다면, 전통문화와 민족문화의 계승 및 발전을 위한 국가의 구체적이고도 적극적인 실현의무가 도출될 수 있을 것이다. 더불어 헌법 제69조는 전통문화의 계승･발전과 민족문화 창달을 위한 국가 과제를 수행하고 이를 성취하기 위한 노력을 다할 대통령의 의무를 규정하고 있다. 따라서 우리의 전통문화와 민족문화 유산을 보호하고 계승･발전시키며 지방문화를 육성하여 문화 분권을 실현해야 하는 국가의 의무는 구체적인 헌법적 근거를 갖고 있다고 할 수 있다. 헌법 전문, 헌법 제9조 및 헌법 제69조 등에 바탕을 둔 문화국가원리는 독자적인 헌법 원리로서 의미를 가질 뿐만 아니라 문화적 차원에서의 최저수준의 보장까지 적극적으로 포섭하는 것으로 이해해야 하며, 헌법 제10조 및 헌법 제37조 제1항 등에서 근거를 찾을 수 있는 문화기본권은 총제적인 성격의 기본권으로 봐야 한다.

영문 초록

Korea currently has 15 UNESCO-registered world heritages. Of them, 13 are cultural heritages and two are natural heritages. These world heritages are not only valuable cultural and natural assets for our people, but also valuable assets that have a great influence on global citizens. The National Heritage Administration, especially the Cultural Heritage Administration, is making various efforts to register UNESCO, and as a result of these efforts, Korea becomes a country with world-class natural and cultural heritage. This article focuses on the discovery, inheritance, development, and globalization of cultural heritage, especially because it aims to evaluate the nation s efforts to combine the perspective of succession and development of long tradition and globalization. It can be said that the role of the state is particularly emphasized in rediscovering traditional culture and creating new values. If our traditional cultural heritage is listed on the UNESCO World Heritage List through efforts of countries and the private sector, it will be the object of cultural enjoyment by people around the world and realize the globalization of our traditional cultural heritage. Such national efforts can be said to be a cross-section that shows the role of the state in the development of national culture as a cultural policy. In a broad sense, we will look at what such national efforts are and how they have constitutional legitimacy through the relationship between the state and culture. In particular, the state s specific and active duty of protection for the succession and development of traditional culture and national culture can be sufficiently derived. In addition, Article 69 of the Constitution stipulates the president s obligation to carry out and achieve national tasks for the succession and development of traditional culture and national culture, so the state s obligation to protect, inherit and develop our traditional culture has a very specific basis. In addition, an understanding of the meaning and nature of the right to enjoy culture as a specific basic right of the people and cultural state principles based on Articles 9 and 69 of the Constitution should be premised.
