국문 초록
온실가스가 생태계에 재앙적인 결과를 가져올 것이라 예상되면서 기후 문제는 오랫동안 정치, 과학, 정의라는 관점에서 격렬하게 논의되어 왔다. 온난화는 온실가스의 배출로 나타나는 직접적인 현상이고, 일단 배출되면 사라지지 않기 때문에 치명적인 기후변화를 막을 수 있는 임계점이 오지 않도록 하기 위해서 온실 가스는 앞으로 한정된 양만 배출할 수 있다. 그런데 우리가 누리고 있는 모든 문명적 삶과 자유는 온실 가스 배출과 밀접하게 관련 되어있기 때문에 법적 측면에서 배출 허용량은 현재와 미래의 자유 배분 문제로 환원된다. 많은 국가에서는 기후 변화를 막기 위한 국가의 노력이 충분하지 못하다는 이유로 기후관련 소송이 한창이다. 그러나 기후변화가 단일 국가의 노력만으로 해결할 수 있는 것이 아니라는 점, 현재보다 미래의 삶과 더 많은 관련을 가진다는 점, 기후변화의 문제를 권리로 주관화하여 접근하기 어렵다는 점에서, 기후 관련 소송은 구조적이고 이론적인 문제에 봉착해 있었다. 그러던 중 독일연방헌법재판소는 2021년 3월 24일, 독일연방기후보호법에 대한 결정에서 청구인의 ‘현재의 권리’와 ‘미래의 권리’가 각각 국가의 ‘기본권 보호의무’와 ‘기간 간 자유 보장(Intertemporale Freiheitssicherung)’에 의해 보장되었는지 검토하였다.
연방헌법재판소는 기후변화를 저지하는 국가의 조치가 기본권 보호의무를 다하지 않은 것인지를 판단하면서, 이러한 보호의무를 다하기 위해서는 기후변화 자체를 직접적으로 막기 위한 조치(직접조치)와 기후변화로 나타난 결과들을 완화할 수 있는 ‘적응조치’(Anpassungsmaßnahmen)가 있어야 한다고 하였다. 연방헌법재판소는 기후보호법이 기본권 보호의무를 위반하였다고 하지는 않았지만, 기후변화와 관련한 단일 국가의 기여가 크지 않는다 하더라도 기후변화를 막기 위한 의무가 여전히 존재한다는 것을 확인하였다. 그리고 추상적 의미의 미래 세대는—전체적으로든 혹은 아직 태어나지 않은 개인들의 총합이든—아직 현재 기본권을 가지지 않기 때문에 이들에 대한 국가의 보호의무는 객관법적 의무로만 파악해야 한다고 확인하였다. 한편 미래의 자유가 현재의 자유에 의해 제한될 수 있는 경우, 시간을 초월해서 작동하는 “기간 간 자유의 보장”(Intertemporale Freiheitssicherung)이 요구되며, 이 때 미래의 기본권은 방어권으로 보호되어야 하므로 비례성에 합치하여야 한다고 하였다. 비례성 검토와 관련하여서는 전통적인 비례성 심사의 방법이 적용되지는 않았다. 입법자가 2030년 이후에 예상되는 혹독한 자유의 감소를 막기 위해 ‘사전 예방적 조치를 취했는가’, 특히 “입법자가 기후중립을 위한 필수적인 개발과 그 전환을 위한 가능하고 조속한 개시를 제공하였는지, 동시에 2030년 이후를 위하여 충분한 개발압력과 계획안전을 제공”하였는가 여부로 판단하였다.
영문 초록
As greenhouse gases are expected to have catastrophic consequences for ecosystems, climate issues have long been vigorously debated in terms of politics, science and justice. Since warming is a direct phenomenon resulting from the emission of greenhouse gases and does not disappear once emitted, it has become a matter of present and future free distribution. However, the lawsuit to prevent climate change was faced with structural and theoretical problems in that it was not a problem that a single country could solve, that it was a problem of future life, and that it was difficult to approach as a right. The German Federal Constitutional Court reviewed whether the German Federal Climate Protection Act violated the claimant s “present rights” and the “future rights” of the claimant. Each criterion was the duty to protect fundamental rights and the guarantee of freedom between periods (Intertemporale Freiheitssicherung). In this decision, the Federal Constitutional Court stated that the duty to protect fundamental rights was to take measures to directly prevent climate change itself (direct measures) and to “adapt measures” to mitigate the consequences of climate change (Anpassungsmaßnahmen). He argued that future generations in the abstract sense-whether as a whole or the sum of unborn individuals-do not yet have the present basic rights, and the state s duty to protect them should be understood only as an objective duty. Although it did not acknowledge the violation of the duty to protect fundamental rights, it said that the duty to protect still exists even if the state s contribution to climate change at the global level is not large.
The most important part of this decision was that it saw that the Constitution required a “guarantee of intertemporal freedom” (Intertemporale Freiheitssicherung) that works beyond the present time. ‘Intertemporale Freiheitssicherung’ (Intertemporale Freiheitssicherung) is the intention of the Federal Constitutional Court to protect the fundamental rights of the future with the right to defend. has the effect of being This decision clarified the meaning of Article 20a of the Basic Law, its international character, and the meaning of judicial review. Regarding the proportionality review, it is not the traditional method of proportionality review, but whether the legislator has taken ‘preventive measures’ to prevent the harsh decline of freedom after 2030. At the same time, it is reviewed whether sufficient development pressure and planned safety are provided”. The absence of such measures and plans and entrusting the federal government with the design of future preventive measures was a violation of the Constitution.
