대통령 법정선거일 이전의 ‘투표’에 대한 헌법학적 일고찰

국문 초록

대한민국에서 대통령선거는 대단히 중대한 의미를 갖는다. 선거로 선출된 1인의 대표자가 독임제 의사결정기구로 기능하기 때문이다. 대통령선거는 다른 공직선거에 비해 후보단일화로 인한 후보자 ‘사퇴’가 많이 발생한다. 이번 제20대 대통령선거에서도 후보자 ‘사퇴’가 발생했고 김동연 후보와 안철수 후보에게 투표했던 재외선거 참여 유권자의 표는 선거권자의 아무런 과실 없이 구조적으로 ‘무효화’되었다. 후보 단일화를 위한 후보를 사퇴한 후보자에 기 투표한 선거권자 선호의 무과실 무효화 문제는 다음 대통령선거에서도 충분히 발생 가능한 경우다. 이러한 위험을 줄일 수 있는 방법은 투표일을 동일하게 하고 단순하게 하는 것이다. 투표일이 길면 길수록 선거일과 차이가 나면 날수록 후보 사퇴로 인한 무효표 양산은 늘어나기 때문이다. 투표율 제고와 유권자 편의성 증대를 위해 도입된 사전투표는 투표율의 극적 향상 없이 유권자의 편의를 위해서만 존재하고 있다. 대폭 축소 혹은 폐지를 논의해야 할 때이고 재외선거는 본국의 선거일이 반드시 포함되도록 조정되어야 한다. 이를 위해 대통령 선거에 한정하여 본국 선거와 동일한 투표일이 포함되는 재외 사전투표의 공관개표 도입을 제안한다. 또한, 투표용지 기표란 활용을 통해 무효표 최소화를 위해 사전투표와 재외선거에서는 양 선거 방식의 투표일을 최대한 동일하게 하고 투표용지 발급기를 통한 기표란 ‘사퇴’ 인쇄와 선거일 투표의 경우 기표란에 ‘사퇴’날인 방식을 제안한다. 가능하면 같은 시기에 유권자들의 후보와 정당에 대한 선호가 집합되어야 선거일 법정의 의미가 증대될 것이고 각기 다른 투표일로 인해 필연적으로 야기되는 후보단일화를 위한 후보자 ‘사퇴’로 인한 기투표자 무효표 양산도 최소화할 수 있다.

영문 초록

The presidential election is very important in Korea. Only one representative is elected by election. In the presidential election, there are more “resignations” of candidates due to unification of candidates compared to other public office elections. In the 20th presidential election, a candidate s “resignation” occurred, and votes from voters participating in overseas elections who voted for KIM and AHN candidates will be structurally invalid without any negligence of voters. The issue of invalidation of the preference for voters who have already voted for candidates who have resigned to unify candidates is a case that can occur sufficiently in the next presidential election. The way to reduce this risk is to keep the voting day the same and simple. This is because the longer the voting day and the more different it is from the election day, the more invalid votes are mass-produced due to the resignation of the candidate. Pre-voting, which was introduced to increase turnout and increase voter convenience, exists only for the convenience of voters without a dramatic improvement in turnout. It is time to discuss a significant reduction or abolition, and overseas elections must be adjusted to include the election date of the home country. To this end, it is proposed to introduce official counting of overseas pre-voting, which includes the same voting date as the home election, limited to the presidential election. In addition, in order to minimize invalidity votes by using ballot indicators, pre-voting and overseas elections should have the same voting days as possible, and in the case of ballot issuing machines, “retirement” should be printed in the ballot box. If possible, the meaning of the election day court will increase only when voters preferences for candidates and political parties are gathered at the same time, and the mass production of invalid votes due to “retirement” of candidates inevitably caused by different voting days can be minimized.
