국문 초록

미등록 이주 아동은 합법적 체류자격을 갖지 못한 채 국내에 체류하는 아동을 의미한다. 아동은 대체로 부모와 함께 국내에 입국하기 때문에 아동이 합법적 체류자격을 상실하는 것은 그 부모가 합법적 체류자격을 상실함으로써 발생한다. 인권의 관점에서 가장 취약한 상태에 놓이는 미등록 이주 아동은 부모가 모두 합법적 체류자격을 상실한 상태에서 출생한 아동일 것이다. 이들은 출생등록 자체가 없어 살아 있으나 존재하지 않는 사람으로 살아갈 가능성이 높다. 따라서 미등록 이주 아동에게는 출생등록에 관한 권리가 최우선적으로 보장되어야 한다. 현재 출생통보제도가 출생등록에 관한 권리를 실현할 수 있는 현실적인 제도로 인식되어가고 있다. 또한 미등록 이주 아동에게는 교육을 받을 권리가 보장되어야 하고, 다양한 사회적 기본권들도 최소한의 내용으로 보장될 필요가 있다. 합법적 체류자격을 갖지 못한 외국인은 누구나 강제퇴거가 될 수 있는데 적어도 한국에서 태어나서 일정 기간 동안 계속적으로 한국에서 체류하고 있거나 상당한 기간 동안 계속해서 한국에서 체류하고 있는 미등록 이주 아동에게는 합법적 체류자격을 부여할 필요성이 있다. 아동권리협약에 가입한 대한민국은 이 협약에서 아동에게 보장하고 있는 다양한 권리들, 특히 평등권을 보장하고, 이 협약의 기본정신인 아동의 최선의 이익을 실현하기 위하여 신속하게 미동록 이주 아동의 인권을 구체화하기 위한 입법을 마련해야 할 것이다.

영문 초록

Undocumented immigrant children refer to children who do not have legal status of residence and stay in Korea. Since children usually enter Korea with their parents, the loss of legal status of residence occurs when the parents lose their legal status of residence. From the point of view of human rights, undocumented immigrant children who are most vulnerable are those who were born with both parents losing their legal status of residence. They do not have birth registration, so there is a high possibility that they will live as people who are alive but do not exist. Therefore, for undocumented migrant children, the right to birth registration should be guaranteed first. Currently, the birth notification system is being recognized as a realistic system that can realize the right to birth registration. In addition, the right to receive education should be guaranteed for undocumented immigrant children, and various basic social rights need to be guaranteed with minimum content. Any foreigner who does not have the legal status of sojourn can be deported, however, it is necessary to grant legal status of residence to at least undocumented immigrant children who were born in Korea and have been staying in Korea for a certain period of time or staying in Korea for a considerable period of time. The Republic of Korea, a signatory to the Convention on the Rights of the Child, must guarantee the various rights guaranteed to children under the Convention, especially the right to equality. And in order to realize the best interests of children, which is the basic spirit of this Convention, it is necessary to quickly prepare legislation to materialize the human rights of undocumented immigrant children.
