한비자는 효를 부정하는가?

국문 초록

한비자는 仁과 義를 비롯한 유가가 주창한 가치들을 부정하며, 인과 의와 같은 도덕 가치를 정치의 영역에서 배제하고자 시도한다. 그러나 한비자 내에는 仁義에 대해 긍정적으로 말한 부분들 또한 존재하며, 인의에 대한 긍정적 서술을 유가의 영향을 수용한 것으로 이해하기도 한다. 그러나 그것들은 유가의 영향을 수용한 결과가 아니라, 군주의 권위 강화라는 목표 아래 재해석한 결과다. 이때, 한비자가 효라는 개념을 긍정적으로 서술하고 있다는 사실은 주목할 만하다. 효를 긍정한다는 것은 효의 내용 가운데 자신의 사상과 부합하는 부분이 있거나, 자신의 사상에 유용한 부분이 있기 때문이다. 한비자는 유가의 인의와 같은 맥락으로 효를 尊君이라는 맥락에 맞추어 재해석한다. 이때, 한비자가 언급하는 효의 실제 내용은 새롭게 만들어진 것은 아니며, 고대부터 존재한 효의 본래 내용이다. 그가 효를 비판한 지점은 정치 영역 상에 있다. 한비자는 인재론을 통해 공적 영역으로 편입된 효를 재해석하여 효를 사적 영역으로 분리해 군주의 권위를 세우고자 하였다. 한비자는 충과 효의 대립 상황에서 충을 기준으로 효라는 가치 자체를 부정한 것이 아니다. 『한비자』 「오두」에 나타나는 효와 충의 대립 문제에 대한 한비자의 관점은 한비자가 효라는 가치 자체를 부정하지 않았음을 보여주며, 한비자의 효 논의가 효의 정치화 시도를 차단하는 것을 목표로 하고 있음을 보여준다.

영문 초록

Han Feizi has no interest in utilizing ethical virtues in his political scheme. Han Feizi denies the value of ren 仁 (benevolence) and yi 義 (righteousness), which are emphasized by Confucian scholars, and attempts to exclude moral ideas from his political pursuit. Even so, some passages of the Han Feizi seem to approve the value of ren and yi and it was understood as the Han Feizi’s reception of Confucian ideas. This is not the case and it should be deemed as a way to reinforce the authority of the ruler. Here, it is noteworthy that the filial piety is described as a positive concept. Han Feizi’s approval of filial piety means that he regards filial piety is in line with his thought or it is useful in fulfilling his political ideals. Han Feizi reframes the concept of filial piety in order to enhance the power of the ruler. But he does not add his own elements to filial piety. Han Feizi’s concept of filial piety basically adopts the original sense of filial piety which is to revere ancestors. His criticism on filial piety is related to political issues. His prime aim is to absolutize the power of the ruler by eliminating the public elements of filial piety and limiting the role of filial piety to the private sector. It should be reconsidered that Han Feizi negates xiao 孝 (filial piety) under the slogan of zhong 忠 (loyalty) when xiao and zhong are in conflict. The dilemmas of filial piety and loyalty in the “Wudu” 五蠧 chapter of the Han Feizi demonstrate that Han Feizi does not negate filial piety and his filial piety discourse is focused on rejecting the attempt to introduce filial piety into the political area.
