교통사고 감소를 위한 범죄학적 고찰

국문 초록

한국의 교통사고는 2011년도부터 2019년도까지 평균 22만여건을 유지하고 있고 사망자도 평균 4~5천명을 유지하고 있다. 10만명당 교통사고 사망자수는 줄어들고 있는 상황이지만 그 전체적인 사고 규모는 별다른 차이를 보이지 않고 있다. 전체적인 교통사고를 줄이고자 하는 다양한 노력에도 불구하고 크게 사고율이 줄지 않는 이유는 무엇이며 이러한 사고감소 방법을 범죄학적 시각에서 원인을 분석하고 대책을 마련해 보고자 한다. 자동차의 교통사고를 미연에 방지하기 위한 사회적 약속은 도로교통법을 통해 일반화 할 수 있다. 도로교통법 제38조(차의 신호)는 ‘모든 차의 운전자는 좌회전, 우회전, 횡단, 유턴, 서행, 정지 또는 후진을 하거나 같은 방향으로 진행하면서 진로를 바꾸려고 하는 경우에는 손이나 방향지시기 또는 등화로써 그 행위가 끝날 때까지 신호를 하여야 한다’라고 규정하고 있다. 차량과 차량 사이에는 의사소통이 필요한데 방향지시등은 이러한 의사소통에 중요한 역할을 한다. 방향지시등의 사용없이 차로를 변경하는 차량은 방향지시등을 켜는 차량에 비해 접촉사고가 발생할 확률이 훨씬 높을 뿐만 아니라, 그 행위가 감정싸움으로 번져 보복운전으로 이어질 가능성이 높다. 경찰청 통계에 따르면 보복운전의 가장 큰 원인이 방향지시등을 켜지 않고 뒤따르는 차를 배려하지 않는 급격한 진로변경(51.3%) 때문이라고 한다. 이 논문은 교통사고의 원인을 범죄학적 관점에서 Sykers&Matza의 중화이론(Neutralization Theory), Travis Hirschi의 사회유대이론(Social Bond Theory), 고전주의에서 주장하는 처벌에 대한 두려움과 무관용(Zero Tolerance)정책, 학습이론(Learning Theory)으로 설명하였고 이에대한 대책을 기술적 측면, 법제도적 측면, 인식변화 및 배려의 관점으로 제시하였다.

영문 초록

In average a year, 220,000 cases of car accidents have occurred in Korea from 2011 and 2019, and fatalities have reached 4,000~5,000 persons a year. Although the number of dead persons in car accidents per 100,000 persons have reduced, there is no particular difference in the overall scale of accidents. Despite our efforts to reduce the number of car accidents on the whole, the study examines reasons why the accident rate does not dramatically decline as well as analyzes its causes from a criminological perspective to come up with solutions. We have social responsibilities to prevent car accidents and we do so by conforming to the Road Traffic Act. According to Article 38 of the Road Traffic Act (Car Signals), ‘All car drivers should use their hands, turn signals or lights for signalling when turning left, turning right, crossing, making a U-turn, slowing down, stopping, reversing or changing the course in the same direction until the act is complete.’ Communication is necessary between vehicles and a turn signal has an important role in communication. Vehicles that change lanes without using the turn signal are more likely to experience a fender-bender than those with the turn signal switched on and they may lead to emotional battles resulting in road rage. The National Police Agency’s statistical report suggests that the biggest reason for road rage is a sudden change in lane without the turn signal switched on and considering the cars following (51.3%). The paper explains the reasons of car accidents from a criminological perspective with Sykes & Matza’s Neutralization Theory, Travis Hirschi’s Social Bond Theory, Fear of Punishment and Zero Tolerance stated in the classical theories and Learning Theory. Accordingly, it presents solutions from the perspectives of technology, legal system, changes in perception and consideration.
