국문 초록

반부패 여건의 확립을 위해 수립하고 있는 제도적 관리적 수행체계 및 운영에 대한 논의들은 그 사회가 처한 사회적 맥락에 따라 발생되어 온 다양한 사건들과 정치적 여건 속에서 변화 발전되어 오고 있다. 이 연구에서는 글로벌 이슈를 주도하는 미국 공공부문 반부패 정책추진체계가 지니고 있는 제도적 변화를 감찰제도를 중심으로 살펴보고 이 과정에서 반부패 정책추진 주체들의 역할과 권한이 지니고 있는 특성들을 검토하였다. 또한 이러한 미국 사례분석 과정을 통해 현재 유사한 법적 제도적 틀을 유지 강화해 가고 있는 우리나라 직무감찰 및 반부패 추진체계와의 비교 및 향후 개선을 위한 시사점을 도출하고자 하였다. 분석 결과 미국 연방 감찰국(OIG)를 중심으로 구성된 공직부패 점검체계는 방대한 연방제 국가조직이 지니는 특성을 반영하여 관련 법률에 따라 설치된 기관들이 각각 독립과 견제의 관계 속에서 유기적인 협조체계를 이루고 있는 것으로 나타났다. 그리고 공직활동 수행과정에서의 위반 행위에 대한 범위와 예외조항, 그리고 처벌 규정 등에 대해서도 매우 구체적이고 상세하게 제시함으로서 공무원의 업무수행과 관련한 예측 가능성을 높이고 이를 통한 공직부패와 관련된 예방 및 점검체계가 작동할 수 있는 기반을 마련하고 있었다. 이러한 분석을 통해 향후 우리나라에서는 반부패정책협의회 등 기관 간 협력체계를 실효성 있게 운영하고 자체감사기구를 적극적으로 활용해 갈 필요가 있다.

영문 초록

Discussions on the institutional administrative performance system and operations established for establishing Anti-Corruption climate have been developed in various events and political circumstances that have been generated in accordance with the social context of the society. This paper examined the institutional change in the US public sector, which leads global issues, focusing on the approval schematic, and reviewed the characteristics of the role and authority of Anti-Corruption policy promotional subjects in this process. We also tried to derive implications for comparative and future improvements to our duty inspection and anti-corruption system, which are currently enhanced by the US Case Analysis process. As a result of the analysis, the Office of Inspector General(OIG), which is centered on the US Anti-Corruption policy, reflects the characteristics of a vast federal national organization, which has a organic cooperation system in which the agencies provided in accordance with the relevant laws, respectively, In additions, It was shown the scope and exceptions to the violation of the public activity and the exceptional provisions, and punishment regulations, and the prophylactic and inspection system related to public servicing related to the performance of public officials. With this analysis, in the future, in Korea, it needs to effectively operate the cooperation system between the agency such as the anti-corruption policy council and actively use the Internal-Audit functions.
