비영리 민간단체의 기부금 운영상 문제점과 개선 방안

국문 초록

최근 비영리 민간단체에 대한 보조금 및 기부금 관련 수사 결과가 언론보도로 알려지면서 각종 비리 및 재정운영상의 문제점이 드러났다. 이는 1990년대 이후 본격적으로 논의된 작은 정부론과 맞물려 진행된 시민사회의 성장에 관한 어두운 부분이라 할 수 있다. 이러한 현상은 그동안 정부의 시민사회에 대한 접근이 지원과 규제완화에만 치우쳐서 발생한 문제라고 판단한다. 비영리 민간단체에 대해 적정한 규제, 규제에 필요한 제도설계, 시민단체에 기부금품을 제공하는 기부자의 권리 보호 등 다각적인 접근이 필요한 시점이다. 현재까지 비영리 민간단체의 투명성을 제고하는 방안 등에 관한 선행연구는 소수에 불과한 상황이다. 비영리 민간단체 기부금품 모집 및 운영과 관련한 문제점은 무엇이며, 어떻게 개선해야 하는가? 본고는 이러한 질문에 답하고자 비영리 민간단체를 관리하는 정부 관리자 측면, 기부금품을 제공하는 기부자 측면, 비영리 민간단체를 운영하는 운영자 측면에서 대안을 모색해보았다. 관리자의 시각에서 보면 기존 법의 제재에서 면제받는 대상 단체가 상당하여 체계적인 관리가 어려운 상황이다. 기부자 입장에서는 기부금품이 필요한 자에게 전달되지 않고 운영자의 사적 유용으로 낭비될 우려가 있으나, 이에 대한 정보가 부족하다. 운영자 측면에서는 성실하고 투명하게 운영하는 비영리 민간단체와 부패한 비영리 민간단체 간의 구분 없이 동일하게 취급당하고 있으며, 인적 및 물적 자원의 한계로 운영이 어려운 측면이 있다. 비영리 민간단체의 운영에 관련한 다양한 행위자의 시각과 이해관계를 고려하여 제도의 관리 사각지대 해소, 통제의 실효성 확보, 투명성 개선역량 지원으로 구분하여 세부적인 제도개선 방안을 제시하였다. 회원에게 모금한 금품도 기부금품법에 포함하여 관리, 정보화시스템 구축, 기부자의 동의에 따른 기부금품의 운영비 추가 사용 허용 등을 통해 비영리 민간단체에 대한 국민의 신뢰제고와 시민사회의 질적 성장이 이루어지기를 기대한다.

영문 초록

The investigation on the collection and use of donations in some nonprofit organizations reveals the corruption of the nonprofit organizations. Since the 1990s, many experts have insisted that the role of the government should be reduced and that the role of the civil society should be increased. With this belief, the regulation on the nonprofit organizations have been mitigated. The absence of the regulation has partly the responsibility of generating the corruption of nonprofit organizations. It is time to find the way for reducing corruption in nonprofit organizations. However, it is not easy to find good studies for this. Only a few studies suggest some plans for improving the collection and use of donations, but their solutions are not comprehensive. What is the way for improving the collection and use of donations in nonprofit organizations? To answer this question, this study adopts three points of view: the government, donors, and operators. With the government’s view, it is not easy to audit and guide nonprofit organizations because of loopholes in laws. With donors’ view, it is plausible that operators might misuse donations and subsidies. Moreover, it is not easy for the donors to know the use of donations due to the low level of transparency. With operators’ view, non-corrupt organizations should be distinguished from corrupt organizations. Also, due to the lack of human and material resources, maintaining the organizations is not easy. This study suggests several solutions to solve these problems. First, the act on collection and use of donations should be revised to remove the loopholes. Second, the government should build the new information system to collect information on the use of donations and open the information to the public. Finally, the government should establish the new agency to help nonprofit organizations.
