자율주행자동차 관련 도로교통법제 정비와 중국 법제의 시사점

국문 초록

이 논문에서는 인공지능 응용기술을 적용한 자율주행자동차의 상용화와 현재 기술의 현황 및 발전을 고려하여 현행 도로교통법규의 적용에 있어 문제점들을 살펴본다. 특히 중국은 정부의 대폭적인 지원으로 인해 인공지능기술을 기반으로 한 자율주행자동차의 도로주행과 관련한 법규가 다양하게 제정되어 있는 상황이다. 이러한 점에서 중국의 자율주행자동차 관련 도로교통 관련 법규를 검토하는 것은 우리의 입법에도 많은 시사점을 제공할 것이라 본다. 중국은 중앙정부와 지방정부가 협력하여 자율주행자동차 도로교통법령을 다양하게 제정하고, 시험적 운영을 통해 또 수정해야 할 부분은 신속하게 개정하고 있다. 자율주행자동차와 관련한 중요하고 핵심적인 법률은 유지하면서 기술지원과 같은 법률은 자율주행기술 단계별 시험적 운영을 시행하고 있다. 또한 자율주행자동차를 보급하기 위해서는 작게는 도시규모, 크게는 전국적 규모의 자율주행기술 인프라 구축이 필요하다. 중국은 스마트 네트워크 도로 구축정책을 통해 도시규모단위를 시작으로 전국적 규모의 인프라구축을 진행하고 있다. 이에는 5G 네트워크 구축, 자율주행자동차용 정밀전자지도, 스마트 네크워크 도로를 위한 표지판 및 신호체계 등의 형성이 그것이다.

영문 초록

In China, with the cooperation of the central and the local government, diverse road traffic laws regarding autonomous vehicles have been legislated, and what needs to be corrected is being rapidly revised through trial operations. While important key laws related to autonomous vehicles are maintained, the laws, for instance, for technical support are being enforced on a trial basis in each step of autonomous driving technology. In addition, for the supply of autonomous vehicles, the infrastructure of autonomous driving technology has to be established at a city level on a small scale and at a national level on a big scale. In China, infrastructure is being established at a national level through the policy to build smart network roads beginning from the unit of a city. The establishment of 5G network, detailed digital maps for autonomous vehicles, and the production of signs and signal systems for smart network roads are its examples. In this thesis, taking the commercialization of autonomous vehicles to which the application technology of artificial intelligence is applied and the present condition and development of contemporary technology into consideration, the problems in the application to the current road traffic laws were examined. Particularly in China, with the drastic support by the government, diverse regulations have been legislated in relation to autonomous vehicles driving on the road based on the technology of artificial intelligence. In this respect, the study on the road traffic laws regarding autonomous vehicles in China will offer many implications to legislation in Korea.
