국문 초록

결론부터 말하자면 현 시점에서 ‘개인정보 보호법 형사처벌규정은 범죄자를 양산하는가?’라는 질문에는 ‘아무도 모른다’고 대답해야 한다. 사람들마다 관념적으로 개인정보 침해의 스테레오 타입이 있겠지만, 이 법은 그 해석, 적용의 범위가 그런 관념을 넘어서까지 넓어질 가능성이 있다. 이 법에 대해서는 많은 지적과 불만이 이어져 왔고, 이러한 사정은 법 제정 10년이 되어가는 지금도 마찬가지이다. 최근에도 개인정보침해를 주장하는 사람들과 이것이 어떻게 개인정보침해냐고 주장하는 사람들의 의견 대립은 팽팽하게 이어지고 있다. 심지어 최근에도 매우 간단한 사실관계인 사건에서 법원의 제1심과 제2심의 결론은 정반대로 내려졌다. 고도로 훈련된 법관들조차 기본적 개념 적용에 대한 판단이 다르다면 일반인들의 혼란은 너무도 당연한 것이다. 물론 대다수의 일반 국민들이 이 법에 대한 이해가 부족한 것도 사실이지만, 이해의 어려움은 이 법 자체에 처음부터 내재된 것이다. 개인정보 보호법은 법명에 비롯되는 오해를 피하기 위해서는 ‘개인정보의 수집과 관리에 관한 법률’ 정도가 적당했을 것이다. ‘인신보호법’이 대다수의 인신구금에 따른 침해를 보호하지 못하고, 정신병원 등에만 적용될 수 있는 것처럼 이 법도 법명이 너무 과하게 설정되어 있다. 일반적 이해와는 달리 원래 특정 개인의 정보누출 피해를 방지하기 위해 만든 법이 아니라, 행정안전부 주도로 주민등록번호를 포함하는 개인정보관리 체계를 수립하고 이를 행정적으로 관리하기 위해 만들어진 법이기 때문이다. 이 법은 모든 개인정보 침해를 보호하는 법이 아니므로 특정 개인의 개인정보 침해는 반사적으로 보호될 뿐이다. 더구나 ‘개인’의 ‘개인정보를 가장 강하게 침해할 수 있는 국가, 공공기관은 제58조에 의하여 제3장부터 제7장의 적용을 받지 않으므로 이들에 의한 침해는 이 법의 규율대상에서 대부분 제외된다.

영문 초록

To start with the conclusion, at the present time, to the question ‘Does the Personal Information Protection Act Criminal Punishment Regulations Mass Produce Offenders?’, it is necessary to answer ‘nobody knows’. Although there may be stereotypes of personal information infringement ideologically for each person, there is a possibility that the scope of interpretation and application of this law will extend beyond that notion. Many criticisms and dissatisfaction with this law have been handed down, and these circumstances are still the same as the 10th year of law enactment. Even in recent years, the conflict between those who insist on personal information infringement and those who claim how this is infringing on personal information has been intensifying. Even in recent years, in a case of very simple facts, the conclusions of the court’s first and second trials were drawn in opposite directions. If even highly trained judges have different judgments about the application of the basic concepts, the confusion among the general public is natural. Of course, it is true that the majority of ordinary people lack understanding of this law, but the difficulty of understanding is inherent in the law itself from the beginning. As for the Personal Information Protection Act, the misunderstanding caused by the name of the law would have been appropriate. Just as the “Personal Protection Act” cannot protect the majority of infringements caused by personal detention and can only be applied to mental hospitals, the legal name is set too much. Contrary to general understanding, this is not a law originally created to prevent damage to information leakage by a specific individual, but to establish a personal information management system including resident registration numbers led by the Ministry of Public Administration and Security and to manage them administratively. Since this law does not protect all personal information infringement, the personal information infringement of a specific individual is only reflectively protected. In addition, countries and public institutions that can most strongly infringe on the “personal information” of “individuals” are not subject to Chapters 3 through 7 pursuant to Article 58, so infringement by them is mostly excluded from the subject of this law.
