국문 초록

본 연구는 한국 사회에서 발생한 종교 자유 침해 사례들을 중심으로한국 사회의 종교 자유 담론을 다루고 있다. 국교 금지와 정교 분리라는두 원칙을 바탕으로 보장된 종교 자유는 우리 사회에서 서서히 발전하였다. 미국, 프랑스, 그리고 독일 같은 나라에서도 종교 자유 문제는 기독교인과 비기독교인, 그리고 특별히 무슬림과의 관계 가운데서 다양한 모양으로 발전하였다. 개인의 신앙 양심을 중심으로 발전한 서구의 종교 자유 담론이 우리나라에서는 주로 종교 권력과 개인 간의 갈등 양상 가운데서 발전하였다. 한국에서의 종교 자유 문제는 주로 국가나 공공 기관에 의한 침해를 중심으로 이루어졌다. 이 연구는 국가와 교회와의 갈등, 양심적 병역 거부, 종립 학교에서의 종교 수업과 채플, 그리고 국가 시행의 각종 시험 요일 문제 등에서 발생하는 종교 자유 침해를 중심으로 다루었다. 다양한 사례들을 살핀 다음, 연구자는 다음과 같은 세 가지사실을 지적하며 논문을 마무리한다. 첫째, 한국 사회에서 종교 자유는느리지만 분명히 향상되고 있다. 차별 금지법에 대한 논의가 구체화되는 점과 대체 복무제의 도입이 그 단적인 예일 것이다. 둘째, 종교 자유에 대한 보다 더 세심한 노력이 필요하다. 예컨대 현재의 징벌적 성격이 강한 대체 군 복무제는 다양한 복무 형태로 제시되어야 하고, 복무 연한도 단축될 필요가 있다. 셋째, 종교 자유에 있어서 다수의 요구만이 아닌 소수의 소리에도 귀 기울일 필요가 있다. 종립 학교에서는 비신자들에 대한 배려가, 정부에서는 금, 토, 일에 몰린 시험일을 평일로 옮기는 문제 등에 대한 고려가 필요하다.

영문 초록

This study deals with the discourse on religious freedom in Korean society, focusing on cases of violations of religious freedom. Religious freedom, guaranteed on the basis of the two principles, the prohibition of a national religion and the separation of church and state, has gradually developed in our society. Even in countries such as the United States, France, and Germany, the issue of religious freedom has developed in a variety of ways in relation to Christians, non-Christians, and especially Muslims. Whereas in the Western world, religious freedom developed centered on individual faith and conscience, in Korea it developed mainly in the midst of conflicts between religious power and individuals. Religious freedom issues in Korea were mainly made up of violations by the state or public institutions. This study focused on the violation of religious freedom that occurred in conflicts between the state and the church, conscientious objection to military service, religious classes and chapels in religious schools, and various problems regarding the scheduling of national board exam days. After examining various cases, the researcher concludes the paper by pointing out the following three facts. First, religious freedom is slowly but clearly improving in Korean society. The specific discussion on the anti-discrimination law and the introduction of the alternative military service system would be a prime example. Second, more careful efforts are needed for religious freedom. For example, the current alternative military service system, which has a strong punitive nature, needs to be presented in various forms of service, and the period of service needs to be shortened. Third, it is necessary to listen to the voices of the minority as well as the demands of the majority for religious freedom. Religious schools need to consider non-believers, and the government needs to consider changing the exam days from Friday, Saturday, and Sunday to weekdays.
