농촌관광마을 활성화를 위한 법·규제개선연구

국문 초록

오늘날 농업은 농산물생산업(1차 산업)에 머무는 것이 아니라, 생산된 농산물을 음식이나 식품으로 제조·유통하거나(2차 산업), 판매하고 농촌에 숙박, 체험하는 서비스까지 제공하는(3차 산업) 넓은 범주의 산업으로 재정의되고 있다. 이른바 1차 산업, 2차 산업, 3차 산업이 융복합화된 6차 산업으로서 농업의 질적 성장이 기대되고 있지만, 이를 뒷받침할 수 있는 법체계는 아직 덜 갖추어져 있다. 현재 농촌관광 관련 영업의 법적 근거는 농어촌정비법, 도농교류법, 농촌산업육성법 등이다. 이밖에 다른 법률들에서는 시설기준, 영업기준, 시설관리 등에 관한 아무런 규정을 마련하고 있지 않다. 결과적으로, 현행 법규정만으로는 농촌관광의 질적성장을 도모할 만한 근본적인 해결책이 될 수 없음을 의미한다고 보고, 다음과 같은 개선방안을 모색해보았다. 첫째, 농촌관광은 헌법상 보장된 “국가의 농어촌․농어업 육성의무 및 농어촌종합개발과 그 지원(제123조)”이라는 목표에 맞도록 법적 근거를 마련하고, 주무부처를 ‘농림축산식품부’로 통합하여 “잘 디자인된 좋은 규제(well-designed good regulations)”가 될 수 있도록 세심한 배려가 필요하다. 정부조직도 농촌관광을 통한 6차산업화가 잘 이루어지도록 실행을 전담지원할 수 있는 통합부서를 설치하고(예, 대만 행정원 농업위원회 사례 원용), 농촌관광사업에 대한 품질인증, 등급제 등을 통한 관리 및 홍보에도 지역활성화차원에서 관련 부처간 협력을 도모할 필요가 있다(예, 일본 지역활성화센터 사례 원용). 둘째, 농촌관광마을의 새로운 유형과 사업모델이 농촌관광 담당 국가기관(농림축산식품부, 농촌진흥청 등)과 농업인의 아이디어가 결합되어 등장하고 있으나, 이러한 유형까지 법적 근거로 포괄하지 못하는 사항이므로 입법 개선이 시급하다. 행위주체기준으로 관광사업 관련 리그제를 도입할 필요가 있는데, 예컨대, 농촌관광사업이라 하더라도 행위주체를 따져 대기업이나 중소기업이 하는 경우는 일반 관광 규제로 하고, 농업인이나 농촌마을이 주체인 경우에는 농촌관광 규제로 차등지원이 필요하다. 셋째, 기타 관련 법률의 입법개선도 수반하여야 한다. 토지의 소유와 거래 관련법규, 민박 등의 숙박시설관련 법규(공중위생법, 소방법), 농촌관광 관련 시설 조성을 위한 농지 전용에 관한 법규(농지법), 건축물을 신 개축할 때 관련 법규(건축법 및 하천법, 도로법, 주차장법 등)등이 그러하다.

영문 초록

This Article is related to the legal study focus on the regulation improvement in the Agri-tourism village in Korea. At last I could make several suggestion and implication to improve some regulations in rural tourism in Korea. First, agri-tourism is a good example of convergence business model(so called 6th Industralization in Agriculture) from the conception itself. Farmers in rural village produce crop(primary industry). They engaged in making some crafts and cooking dishes or making food(secondary industry). Futhermore they offer various services(e.g. lodging, experience, education, leisure etc.) and sell the processed product(tertiary industry). In doing so, rural tourism village could create added value, as well as provide the leisure to tourist visiting village. Taiwanese and japanese cases visiting not only domestic tourist but also so many overseas tourist show the developed rural tourism model in cooperation between farmers and government. Second, rural tourism village needs well-designed regulations and amendments to rural tourism-related legislations considering its unique characteristics. In respect of modern a scholarly approach on the regulation, this study emphasizes 3 regulations, 1) responsive regulation or smart regulation, 2) sustainable regulation, 3) case-target regulation. It is point that some kind of regulation related rural amenity, superiority of environment, supporting ecosystem must tighten. Lastly, Korean Food Sanitation Act applies from making to selling processed food so that it drives many farmers and green tourism villages hard time in so many cases. 1) under strict enforcement of regulations through article 13(ban on the false advertising and labelling) farmers was accused of running false and exaggerated advertisements. It is constructed on the same principle as general food. It needs distributive justice and concrete validity. 2) As regards scale or size, Korean Food Sanitation Act dual regulation approach. It hold back large scale agri-tourism, on the other hand it has deficit of law in small scale ones. 3) Korean Food Sanitation Act keep facility standard without respect to traditional fermented food, so that many farmers could be confronted with a difficult problem to get permission from government.
