재해는 인간 스스로의 활동이나 자연의 현상으로 인해 결국 인명과 재산상의 피해로 나타나는 것을 말한다. 인간 활동이 다방면에서 늘어나면서 예상하지 못한 재해가 수량뿐만 아니라 강도와 규모에서도 증가하고 있다. 과학기술이 발달한 현대국가 체제에서는 예기치 못한 재해를 극복하기 위한 노력을 기울여 오면서 하나의 방편으로 법·제도적 조치를 취하고 있다. 북한의 재해 정보가 잘 드러나지 않은 상태에서 북한의 재해법제 내용상 특징을 파악하는 것은 재해에 대한 북한의 인식, 재해 관리와 체계, 운용방법 등에 대한 기본지식을 얻을 수 있다. 북한의 『재해방지 및 구조, 복구법』은 13개의 재해에 대한 방지, 구조, 복구에 대한 기본법으로 조문 내용이나 구체성 면에서 북한의 재해에 대한 인식과 운용상 특징을 평가할 수 있다. 한반도에서의 재해는 성격상 남북한의 정치·군사적 긴장관계에서 분리하여 남북협력의 가능성이 큰 분야로, 북한의 『재해방지 및 구조, 복구법』의 특성을 파악하는 것이 남북 재난협력을 위한 첫 단계일 것이다. 본 글에서는 2014년에 채택된 북한의 『재해방지 및 구조, 복구법』의 내용상 특성을 도출하여 북한의 재해에 대한 인식과 운용실태를 파악하고자 한다. 이를 통해 남북 상생기의 재해 협력과 재해 정보교류에 활용할 수 있을 것이다.

영문 초록

A disaster is a loss of life and property due to human activity or natural phenomena. As human activities increase in many ways, unforeseen disasters are increasing not only in quantity but also in intensity and scale. In the modern state system with advanced science and technology, efforts have been made to overcome unexpected disasters, and legal measures are taken as a means. Understanding the characteristics of North Korea s disaster legislation in the absence of information on disasters in North Korea can provide basic knowledge on North Korea s perceptions of disasters, disaster management and systems, and operational methods. North Korea s Disaster Prevention, Rescue, and Restoration Act is a basic law on the prevention, rescue, and restoration of 13 disasters. It can evaluate the characteristics of North Korea s disasters and its operational characteristics in terms of the contents and specificity of the provisions. Disasters on the Korean Peninsula are, by their nature, separated from the political and military tensions between the two Koreas, and are likely to be inter- Korean cooperation. would. In this article, we will derive the characteristics of North Korea s Disaster Prevention, Rescue, and Restoration Act, adopted in 2014, to understand North Korea s awareness and operation of disasters. Through this, it can be used for disaster cooperation and disaster information exchange in the inter-Korean win- win period.
