국내 북한인권 관련 비정부단체가 북한 인권에 끼친 영향

국문 초록

국제사회에서 인권의 사각지대인 북한 인권상황에 대해 적극적으로 대응하고 해결하기 위한 노력과 관심이 증가하고 있다. 이러한 국제적 움직임 속에서 유엔의 북한 인권결의안이 10여 차례이상 채택되었고, 미국, 일본 등에서 북한 내 인권상황의 개선과 증진을 위한 북한인권법이 제정되었다. 본 연구는 한국 내 북한 인권문제를 다루는 비정부단체(Non-governmental Organizations) 10개를 중심으로 미국과 일본에 비해 대한민국 국회에서 북한인권법 제정이 지체된 원인과 배경을 살펴보고, 국내 비정부단체들이 입법 추진 과정에서 기여한 역할과 내용을 분석하였다. 이론적 분석틀로는 국제관계 이론인 구성주의에서 현실에 대한 사회적 구성(the social construction of reality)과 정당성의 개념(the concept of legitimacy)을 도입하여 비정부단체들이 북한인권법 제정에 단계적으로 기여한 바에 대해 분석하였다. 본 논문은 지난 10여 년간 10개 비정부단체들의 업적과 성과를 조사하고 이들이 북한인권법 제정에 기여한 바를 입증하였다.

영문 초록

Human Rights in North Korea has increasingly become a great concern for the international community. North Korean Human Rights Resolutions approved by the UN and the promulgations of North Korean Human Rights Acts in the U.S. and Japan over the last decade, followed by the National Assembly of the Republic of Korea’s human rights legislation in 2016, have been done to improve human rights conditions in North Korea. In this research, ten prescreened NGOs founded and operated in the ROK have been surveyed to determine their effectiveness for improving human rights in North Korea. In order to do so, their contribution in drafting and enacting the North Korean Human Rights Act are closely examined through a constructivist lens. Throughout the analysis, based on application of the constructivist notion concerning a normative environment, the concept of legitimacy, and the creation of social facts, it is empirically proven that the NGOs contributed to every sector involved with the promulgation of the North Korean Human Rights Act in the ROK.
