이원정부제 도입 배경 비교와 한국에서의 문제점 고찰

국문 초록

최근 정치권은 권력구조(power structure) 개편을 위한 개헌을 분명히 하고 있다. 검토되고 있는 권력구조 가운데 이원정부제(분권형 대통령제)에 대한 국내외 학계의 연구를 보면 프랑스 제5공화국과 독일 바이마르 공화국의 경험을 중심으로 도입 배경과 오스트리아, 핀란드, 폴란드, 러시아와 같은 국가들의 운용 사례와 민주주의와의 상관관계가 연구된 바 있다. 하지만 프랑스와 독일, 오스트리아나 핀란드, 폴란드, 포르투갈 등의 이원정부제 도입의 정치적 배경과 정치세력들의 타협 조건의 비교, 그리고 도입·운용했던 이원정부제에 변화를 가져온 이유들에 대한 체계적 연구는 찾기 힘들다. 본 연구에서는 이원정부제가 독일과 프랑스를 넘어 유럽 전역에서 다양한 형태와 방식으로 운용되고 있는 이유, 그 역사적 유산과 배경을 설명하고 비교한 뒤 한국에의 도입 적실성과 운용의 문제점을 논의하고자 한다. 특히 이원정부제 권력구조란 체제 변혁기 정치세력 간의 정치적 타협의 산물인데 당시의 타협의 내용과 배경을 비교할 것이다. 본 논문에서는 프랑스, 핀란드, 오스트리아, 독일, 포르투갈, 폴란드에서의 이원정부제 도입 역사를 복기하고 도입 사유와 안정된 운용의 원인을 비교 검토한다. 특히 이원정부제로의 이행에서 중요한 요인이라고 할 수 있는 ‘전통과 환경의 조합’(the combination of tradition and circumstance)을 분석한다. 하지만 여기에는 ‘정치 행위자’(political actor)의 역할이 빠져 있는데 이를 보완한다. 정치 행위자들의 ‘타협’(pact)은 이후 이원정부제 운용의 기본 원칙으로 작용하고 있어 중요하다. 이러한 이원정부제 도입과 타협의 내용, 변경의 환경적 요인의 탐구는 이원정부제가 초래할 정치적 불안정을 극복하는 모색하는데 도움을 줄 것이다.

영문 초록

The National Assembly of the Republic of Korea has discussed to introduce a new power structure of semi-presidential system or parliamentarism. This article not only examines the backgrounds of adopting semi-presidential systems in France, Finland, Austria, Weimar Germany, Portugal, and Poland, but also provides the Committee of Constitutional Reform with some insights why and how the politicians of the above countries agree to change into the system. This article compares and contrasts the combination of tradition and circumstances, Maurice Duverger’s terms, when France, Finland, Austria, Weimar Germany, Portugal, and Poland chose the semi-presidential system and examines why politicians or political parties had compromised. This article concludes that most of semi-presidential countries tried to meet the peoples’ as well as politicians’ demands of presidents substituting King or Secretary General, some countries wanted to have important figures as a president to handle internal or diplomatic crisis, and a few countries had to have the position of the president following the interest of revolutionary army. However, we have to aware, as the diplomatic crisis has ended and the power of army has been fading away, many of the semi-presidential countries have changed gradually their political systems into parliamentarism or premier-presidential type.
