국문 초록

본 연구는 UN장애인권리협약 선택의정서 비준이 필요함에도 10년 넘게 비준이 안 되는 현실에서, 선택의정서 비준의 필요성 및 방해요인은 무엇인지, 비준 전에 준비할 사항은 무엇인지, 비준 이후 과제는 무엇인지 등에 대해 구체적으로 검토하기 위해 장애분야 전문가와 타 협약 전문가를 대상으로 면접을 실시하고 내용 분석을 실시하였다. 분석 결과 선택의정서 비준의 필요성을 명확히 확인할 수 있었다. 비준 이후 국내법, 제도, 구제와 관련한 충돌가능성은 협약에 의한 문제이지 선택의정서 비준으로 추가 발생하는 문제가 아니라는 점을 분명히 인식해야 한다. 또한 비준 이후 개인진정건이 다수 발생할 것이라거나 국가주권의 과도한 제약이 있을 수 있으리라는 예상은 과도한 우려일 수 있으며, 오히려 선택의정서 비준의 실효성이 낮을 가능성이 있으므로 선택의정서 비준 이후의 실효성 향상을 위한 방안을 선제적으로 준비해야 할 필요가 확인되었다. 이 연구는 우리나라의 UN장애인 권리협약 선택의정서 비준 논의에 기초자료로 활용될 것으로 기대된다.

영문 초록

In the reality that ratification of the Optional Protocol to the UN Convention on the Rights of Persons with Disabilities has not been ratified for more than 10 years, it is necessary to examine the facts such as what are the necessity and obstacles to ratification, what should be prepared before ratification, and what are the tasks after ratification. In order to examine in detail, we conducted interviews with experts in the field of disabilities and experts in other conventions and analyzed the contents. As a result of the analysis, the necessity of ratifying the optional protocol was clearly confirmed. After ratification, it should be clearly recognized that the possibility of conflict with respect to domestic law, institutional and remedy is a matter of the Convention and not a further arising from ratification of the Optional Protocol. In addition, the expectation that a number of individual complaints will occur after ratification or that there may be excessive restrictions on state sovereignty may be excessive concern, and rather, the effectiveness of ratification of the optional protocol may be low. Therefore, it was confirmed that it is necessary to preemptively prepare a plan for improving the effectiveness after ratification of the optional protocol. This study is expected to be used as basic data for discussion on ratification of the optional protocol of the UN Convention on the Rights of the Persons of Disabilities in Korea.
