국문 초록

본 연구에서는 신체일부의 절단이나 기능의 손상을 통해 자신의 정체성이 완성된다고 믿는 사람들을 소개하며, 트랜스에이블을 명명하게 된 과정을 살펴보았다. 또한 트랜스에이블을 정신질환으로 보는 의료계의 태도를 기반으로 의료윤리와 트랜지션 수술의 동의능력에 대한 논의를 소개했다. 트랜스에이블의 개념을 트랜스젠더와 비교하는 해외의 논의를 통해 공통점과 차이점을 제시했으며, 장애이론의 흐름에서 트랜스에이블을 이해하기 위해 장애의 인권모델을 소개하고 이론을 통한 트랜스에이블의 인정투쟁 가능성을 제시했다. 나아가 대법원과 헌법재판소의 판례를 토대로 환자의 치료선택권에 기반한 장애선택이 가능할지와 사회복지 급여를 수령하는 문제와 같은 현실과의 접점을 찾고자 했다. 본 연구는 트랜스에 이블을 국내에 최초로 소개함으로서 현재 장애학이 포괄하고 있지 못하는 장애 범주에 대한 고민을 확장케 했다는 의의를 지닌다. 나아가 본 연구를 기반으로 향후 장애수급자격 및 진정성 문제와 관련한 경제·사회적 자원의 분배와 같은 다양한 논쟁지점을 발견할 수 있기를 기대한다.

영문 초록

This study introduces people who believe that their identity is completed through amputation of a part of their body or impairment of function, and examines the naming process of ‘transabled’. In addition, a discussion on medical ethics and the ability to consent to transition surgery was introduced based on the attitude of the medical community that regards transabled as a mental illness. Introducing a discussion abroad that compares the concept of transabled with transgender people, presented commonalities and differences, introduced the human rights model of disability to understand transabled in the flow of disability theory, and explored the possibility of the struggle for recognition of transabled through theories. Furthermore, through the precedents of the Supreme Court and the Constitutional Court, we tried to find a point of contact with reality such as whether it is possible to select a disability based on the patient s treatment option and the issue of receiving social welfare benefits. This study is of significance that by introducing transabled for the first time in Korea, it has expanded the concerns about the categories of disability that are not currently covered by disability studies. Furthermore, it is hoped that various points of debate, such as the distribution of economic and social resources related to disability eligibility and authenticity, can be found.
