국문 초록

역대 정부에서 권력기관 특히 검찰을 개혁하기 위해 많은 노력을 해왔지만 , 검찰조직의 강력한 반발로 번번이 실패하였다. 문재인 정부 들어 수사권 조정을 위한 형사소송법과 검찰청법이 2020년 초에 국회를 통과하였고, 고위공직자범죄수사처 설치 및 운영에 관한 법률이 2020년 말에 국회를 통과하였다. 이로써 일정 부분 무소불위 검찰의 권한을 분산시켰지만 여전히 우리나라의 검찰은 각종 영장청구권을 독점적으로 보유하고 있고, 기소권 등을 행사하고 있다. 이제 영미법계 국가들처럼 수사와 기소의 완전한 분리를 통해 인권침해를 방지하고 실체적 진실발견에 좀 더 다가서야 하는 또 다른 과제가 우리 앞에 놓여 있다. 수사와 기소의 분리가 완전한 검찰개혁이요, 동시에 선진적인 형사사법시스템의 완성이기 때문이다. 양자의 분리가 가져올경찰권력에 대한 통제는 자치경찰제와 국가수사본부의 설치, 경찰옴부즈맨, 경찰 내부의 통제방안으로 달성할 수 있다.

영문 초록

Although the previous government has made efforts to reform the power institutions, especially the prosecution, it has failed repeatedly due to strong opposition from the prosecution organization. Moon Jae-in government passed the Criminal Procedure Act and the Prosecutors Office Act in early 2020, and the Act on the Establishment and Operation of the Criminal Investigation Department of High-ranking Public Officials passed the National Assembly at the end of 2020. As a result, some of the authority of the prosecution has been dispersed, but the prosecution of Korea still has exclusive rights to claim various warrants and exercises the right to prosecute. Now, like the Anglo-American law countries, another task is in front of us to prevent human rights violations and to get closer to the discovery of substantive truths through complete separation of investigation and prosecution. The separation of investigation and prosecution is a complete prosecution reform, and at the same time, the completion of an advanced criminal justice system. The control of the police power brought by the separation of the two can be achieved by the self-governing police system, the establishment of the National Investigation Headquarters, ombudsman and the control plan inside the police.
