「소년법」상 수용보호처분의 문제점과 개선방안

국문 초록

일본, 미국, 영국에 비해 지난 10년간 우리나라의 소년보호처분 인원의 감소율은 낮고, 수용보호처분 부과인원은 증가하고 있다. 소년 수용보호처분 인원이 증가하고 전체 보호처분에서 차지하는 비중도 늘어나고 있는 것은 소년 수용보호처분을 명할 범죄의 중대성 요건, 수용기간의 가능한 최소한의 범위가 법률에 규정되어 있지 않고, 수용처분 이외의 대안적 보호처분의 부족에 상당 부분 기인하고있는 것으로 생각된다. 현행 6호 처분은 9호보다 중한 내용을 갖는 수용처우라는점에서 죄질이 높지 않으나 보호환경이 열악한 소년의 보호기능을 강화하려는 처분의 취지에 맞지 않는다고 본다. 6호 처분의 취지 달성을 위해서는 소년의 주된생활근거지 주변의 소규모 그룹홈에서 개방처우로 운용되는 것이 바람직하며, 보호관찰소 소재지 중심으로 6호 처분 수탁기관을 발굴하고, 자치단체가 예산을 분담하도록 할 필요가 있다. 소년원 송치 제도의 개선을 위해 소년원 송치 처분의부과 기준을 법률에 정하여 보호관찰 기간 중 단순 준수사항 위반으로 보호처분변경되어 소년원에 송치되는 사례를 방지하고, 소년원 송치 기간을 단축하기 위해 의무적 임시퇴원 제도를 도입하고, 임시퇴원 후 보호관찰 기간 및 임시퇴원취소 시 재수용 기간을 합리화하며, 전자감독과 외출제한명령을 활용하여 소년원송치 처분을 제한하는 등의 방안이 모색되어야 한다고 본다

영문 초록

In recent ten years, compared to Japan, the U.S., and U.K., in Korean juvenile courts, a reduction rate of disposition orders has been lower and the number of juvenile custody orders has been increasing. This phenomenon seems to be caused by the following reasons : a gravity of a crime is not required for juvenile custody orders; the minimum term of a custody order is absent in the Juvenile Act; and the alternatives to custody orders are insufficient. Because Dispositon no. 6 is heavier than Dispositoin no. 9 because of its duration, it is not suitable for juveniles who are not highly delinquent but have poor family environment. Disposition no. 6 needs to be managed as follows : it should be a non-custodial order; a small group home near juveniles’ living areas is appropriate; more facilities need to be established; and a local government should be encouraged to supprt the budget. Requirements for juvenile custody orders should be legalized in the Juvenile Act. By this revision, juveniles will be less likely to return to a juvenile detentin center because of a violation of conditions. Mandatory early release needs to be introduced in order to reduce the custodial period. In addition, electronic monitoring and a curfew order should be used as the alternatives to custody orders.
