국문 초록

이 연구의 목적은 중소기업에 종사하는 연구개발 인력이 사내 핵심기술을 유출함에 있어 영향을 미치는 요인을 경험적으로 분석함에 있다. 일반적으로 알려진산업 기술유출의 가장 빈번한 방법은 전·현직 임직원 등 내부자들에 의한 유출이다. 그러나 다수의 선행연구들이 기술유출을 막기 위해 법제도 개선방안에 대한 논의나 정보보안에 초점을 맞춘 유출 방지 프로그램 혹은 네트워크 구축 등을중심으로 이루어졌다. 내부자들이 왜 범의(犯意)를 갖게 되는가에 대한 본질적 질문에 답을 구하는 선행연구는 부족한 실정이며, 이러한 범의를 유발하는 원인에대한 실증적 연구 역시 부족하다. 따라서 이 연구는 내부자들이 기술유출을 결정하게 하는 요인들을 실증적으로 확인하고자 하였다. 이를 위해 총 82개의 중소기업에 종사하는 연구·개발 담당 252명의 설문 응답 자료를 바탕으로 인공신경망(Artificial Neural Network) 분석을 실시하였다. 이 연구의 목적을 달성하기 위하여 주어진 시나리오 상황에서의 기술유출 의도 유무, 자기통제력과 같은 개인적요인, 적발의 확실성, 법적 처벌 강도와 같은 억제요인, 직무스트레스, 직장내 갈등과 같은 직무환경 요인 등을 변수로 설정하고 분석하였다. 분석결과, 적발의 확실성, 연봉 만족도, 법적 처벌 강도 등이 기술유출 의도에 주요한 영향을 미치는것으로 나타났다. 이러한 연구결과를 바탕으로 기술유출 사건에 있어 형사사법기관의 신속하고 적극적인 개입과 강력한 처벌이 필요하다는 결론을 도출하였다.

영문 초록

The purpose of this study is to empirically analyze the factors that influencing R&D researchers engaged in SMEs in leaking core technologies in the company. The most common known method of industrial technology leaks is leakage by insiders such as former and current employees. However, a number of prior studies have focused on discussions on ways to improve the legal system to prevent technology leakage, leakage prevention programs or networks focusing on information security. There is a lack of prior research to answer essential questions about why insiders have criminal intent, and also a lack of empirical research into the causes of these crimes. Therefore, this study tried to empirically identify the factors that led insiders to determine the technology outflow. An Artificial Neural Network(ANN) analysis was conducted based on the survey response data of 252 R&D researchers engaged in a total of 82 SMEs. In order to achieve the purpose of this study, the presence or absence of intention to leak skills in a given scenario was set, and personal factors such as self-control, certainty of detection, deterrent factors such as intensity of legal punishment, and job environment factors such as conflict in the workplace were set and analyzed. As a result of the analysis, it was found that the certainty of detection, satisfaction with annual salary, and the intensity of legal punishment had a major influence on the intention of technology leakage. Based on these findings, it was concluded that strong punishment through rapid and active intervention by criminal justice agencies is necessary.
