홉스의 리바이어던 자연법사상과 자경주의에 관한 법철학적 고찰

국문 초록

한국의 경찰은 2020년 검경수사권 조정에 이어 자치경찰제도의 도입을 앞두고 대민관계에 적지 않은 책임을 가지고 있다. 이 논문은 국민주권을 행사하는 한 방법으로서자경주의 현상과 국가의 공권력의 관계를 토마스 홉스의 자연법사상에 비추어 고찰한다. 홉스는 17세기 근대국가의 설립에 대한 이론을 제시한 학자로서 국가를 지상의 신리바이어던이라고 부르면서 공권력을 강조했다. 필자는 이점을 감안하여 자경주의 현상과 공권력의 관계를 법철학적으로 논할 것이다. 이를 위해서 우선 자경주의 현상을정의하고, 공권력과의 관계에 대한 법철학적 연구의 필요성을 제기한다. 다음 홉스의리바이어던 자연법사상과 공권력, 인간관과 국가관, 사회계약설과 공권력 독점주의를차례로 고찰한다. 그리고, 홉스의 자연법사상에서 강조한 공권력이 자경주의 현상에어떠한 시사점을 주는지를 논할 것이다. 그 결과, 홉스에 따르면, 합리적인 개인이 자신의 생명보존을 위해 국가를 설립하고 이에 막강한 공권력을 부여하였으므로, 자경주의적 행위는 공권력의 범위 안에서만 허용될 수 있음을 알게 되었다. 이 연구는 기존의 공권력 독점 관행에 자경주의 현상을 조화해서 민간의 사회참여를 독려할 수 있는명분과 방안의 마련에 대한 새로운 법철학적 안목을 제시한다.

영문 초록

The Korean Police has no litle responsibility in the public relations with citizens facing the introduction of the local police system after the adjustment of the investigative authority of the prosecution and the police in 2020. This paper observes the relationship betwen the phenomenon of vigilantism, as a way of exercising the right of national sovereignty, and the governmental authority in the light of Thomas Hobbes s idea of natural law principle. Hobbes, a scholar presenting the theory of enacting the 17th century modern country, emphasized the governmental power by caling the country Leviathan, the Earthen God. Considering this aspect, I wil discus the relationship betwen the phenomenon of vigilantism and the governmental authority. First, I define the phenomenon of vigilantism and raise the necesity of the research of legal philosophy to its relations with the governmental power. Next, I observe Hobbes s Leviathan natural idea, the governmental authority, the view of humans and countries, the theory of social contract, and monopolism of governmental power one by one. Based on the result, I wil argue what implications the governmental authority stresed in the Hobbes s idea of natural law principle give to the phenomenon of vigilantism. Through the analysis, acording to Hobbes, sensible individuals established a nation for keping their lives and granted the enormous power to it, and so the acts of vigilantism should be alowed only in the range of the governmental power. This study sugests a new view of legal philosophy as to the cause and method to harmonize the phenomenon of vigilantism with the existing practice of monopolizing the governmental authority and encourage the citizens social participation.
