「지역문화진흥법」에서의 문화환경 취약지역 관련 규정 개정방향에 대한 고찰

국문 초록

우리나라는 수도권에 인구와 경제력이 집중되어 생활서비스 접근성 측면에서 지역간불균형 지속되고 있다. 수도권과 지방의 격차는 문화부문에서도 마찬가지이다. 이에지역간 문화 격차 해소를 위한 국가의 적극적 정책이 필요하였으며, 2014년 지역문화진흥법 이 제정되었다. 문화환경 취약지역을 우선 지원할 수 있는 근거규정이 제9조및 시행령 제6조에 마련되어 있지만, 정의규정, 문화환경 취약지역의 선정기준, 문화체육관광부의 역할, 인센티브 부여 등에 대한 문제가 있다. 본 연구는 이러한 문제점에 대하여 타 부처 법률과 주로 비교하여 개정방향을 제시하였다. 먼저, 문화환경 취약지역에 대한 정의규정 마련이 필요하며, 문화환경 취약지역은중소도시의 낙후지역도 포함될 수 있어야 한다. 선정기준은 원점에서 재검토 하여 ‘인구’, ‘재정’, ‘생활환경’ 등 간략한 키워드 형식의 기준을 우선적으로 법에 규정하고, 시행령에서 이와 관련된 구체적인 기준을 열거하는 형식으로 정비될 필요가 있다. 그리고 문화체육관광부장관이 실질적으로 문화환경 취약에 대한 지역에 선정 또는 지원을할 수 있도록 개정을 검토할 필요가 있다. 또한 지방자치단체가 사업을 성공적으로 수행하는 경우 향후 예산의 증액지원 등 인센티브 등을 부여할 수 있도록 지역문화진흥법에 근거규정이 마련되어야 한다.

영문 초록

In Korea, population and economic power have ben concentrated in the metropolitan area. It has caused an imbalance betwen the regions regarding acesibility to living services—the gap betwen the metropolitan area and the rural areas. In the same way, there are cultural gaps. Acordingly, an active policy of the state is neded to bridge the cultural gap betwen regions. Thus, the Local Culture Promotion Act(LCPA) has ben enacted. In Article 9 of this Act and Article 6 of the Enforcement Decre, there are ground rules to provide priority support for vulnerable areas of cultural environment. However, there are problems with definitions regulations, selection criteria for vulnerable areas of cultural environment, active administrative support from the Ministry of Culture, Sports and Tourism(MCST), and granting of incentives. This study presents a revision direction for these problems by comparing them with other ministries laws. First, the vulnerable areas of cultural environment should include the underdeveloped areas of smal and medium-sized cities, and it is necesary to prepare definitions for the cultural environment vulnerable regions. The criteria for selecting the vulnerable areas of cultural environment ned to be reviewed from the original point, and the criteria in the form of simple keyword such as ‘population’, ‘finance’, ‘living environment’, etc., should be prescribed in the law first, and specific criteria related to this should be listed in the enforcement decre. It is also necesary to review the revision so that the MCST can select or support regions for cultural weakneses. In addition, in the case of sucesful project execution by local governments, provisions based on the LCPA should be prepared so that incentives, such as support for increasing the budget in the future, can be given.
