모병제 도입에 대한 공법적 고찰

국문 초록

한미동맹 등으로 군사적 안보국익을 공유해 온 미국은 징병제를 유지하다가 1973년베트남 전쟁 중 전격적으로 모병제로 전환하여 현재에 이르고 있다. 헌법상 국가안전보장의 수행 방식에 대한 국민인식변화, 인구감소로 인한 병력수급의 어려움, 사회상의 변화 등으로 인하여 모병제 도입의 필요성이 제기되고 있다. 본 연구는 국방부, 합동참모본부, 병무청 등의 정책자문위원과 업무평가위원 경험을 토대로 모병제 도입에대한 행정법적 개선방안을 연구하였다. 연구의 목적은 현행 징병제의 대안으로서의 모병제 도입의 방안을 입법적으로 설계하는 것이다. 연구방법으로는 징병제의 문제점을진단하고, 근거법령과 선행연구 등을 문헌적으로 고찰하였다. 연구의 내용으로는 미국, 독일, 프랑스 등의 사례를 분석한 후, 모병제 도입을 위하여 병역법 등의 행정법적인고찰로서 현행 군복무 법령 등을 검토하였다. 군복무의 행정체계에 대한 행정법적 진단은 크게 두 갈래로 진단된다. 하나는 행정조직법적 진단으로서 사실상 군의 간부와예비역, 보충역의 인사에 관한 규정으로서 병과와 계급, 복무 등을 규정한 ‘군인사법’이며, 다른 하나는 행정작용법적 고찰로서 헌법상 병역의무이행을 구체화하는 징집에 관한 징병제의 근거 법률인 ‘병역법’, 예비군의 편성과 조직에 관한 규정인 ‘예비군법’과기타 관련 법률로서 ‘비상대비자원관리법’, ‘민방위기본법’ 등이다. 군복무 법제의 개선방안으로 모병제를 도입하기 위해서는 모병제 군복무 시스템을 제도화한 새로운 법률의 입법화가 필요하다. 이를 위하여 가칭 ‘군복무기본법’을 제시하며 향후 병역법을 대체할 입법에 활용될 수 있다고 기대할 수 있다.

영문 초록

The curent military service system is based on the Military Service Act as a concrete law for the performance of military service under the Constitution. The ned for the introduction of the recruitment system has ben raised due to changes in national awarenes of constitutional values for national security, dificulties in the supply and demand of trops due to population reduction, and social changes. Based on the experience of policy advisors and task evaluators of the Ministry of National Defense, Joint Chiefs of Staf, and Military Manpower Administration, this study studied administrative and legal aspects of the ned for the introduction of a recruitment system. The purpose of the research is to design the method of introducing the recruitment system as an alternative to the conscription system in legislation. The methods of research were to diagnose the problems of the curent conscription system, and to consider the basis laws and prior studies. The study considered changes in the U.S. system, which has shared military security and national interests through the Korea-U.S. aliance. In other words, the government considered the background of the military conscription system, which was maintained, and then switched to a military recruitment system during the Vietnam War in 1973, and the operation of the military service system afterwards. Next, we loked at the cases of Germany, which switched to recruitment in 2011, and France, which switched to recruitment in 2001. The basis law for the administrative system of military service is largely divided into thre branches. One is, in efect, about personnel management of the military, reservists and reservists, and the Military Personnel Act, which stipulates military service, rank, service, etc. The second is the Military Service Act, which is the law based on the conscription system that embodies the performance of military service under the Constitution. Third, the Reserve Forces Act on the formation and organization of reserve forces and other related laws, including the Emergency Resources Management Act and the Framework Act on Civil Defense. The research result sugested that if the military service system is changed to a recruitment system, the military service law should be abolished, a new law that institutionalized the military service system should be legislated, and that the military service basic law, tentatively caled the Military Service Basic Act, should be enacted, as in the case of the United States. The use of research is expected to be used in legislation to replace the military service law in the future.
