국문 초록

국가가 수사권과 형벌권을 독점하는 한계 속에서도 형사소송법은 고소인에게 수사기관의 처분에 불복함으로써 수사권·공소권의 남용을 통제하는 역할을 일정 부분 부여해 왔다. 특히 금번 개정 형사소송법 및 검찰청법은 기존의 검·경 간의 관계 및 수사권한을 근본적으로 조정하였고, 피해자 등 사건관계인으로 하여금 경찰수사를 통제할 수 있도록 하는 장치를 마련하는 등 새로운 변화를 예고하고 있다. 본 논문에서는 수사구조 변화에 따른 형사절차상 피해자의 법적 지위의 변화를 염두에 두고, 개정 형사소송법의 취지에 부합하도록 피해자의 이익이 형해화되어서는 안 된다는 입장에서 다음과 같이 논의를 진행하였다. 먼저, 형사소송법상 고소의 성격과 기능을 조명하여 피해자의 기본권의 관점에서 고소의 중요성을 명확히 하였다. 또한 고소사건을 중심으로 수사기관의 권한 변화가 피해자의 이익에 어떠한 영향을 미쳤는지를 연혁적으로 검토함으로써 개정 형사소송법의 영향을 가늠해 보았다. 이를 토대로 개정 형사소송법이 상정하고 있는 피해자의 법적 지위를 확인하고, 개정법의 취지에 부합하기 위한 앞으로의 과제를 제시하였다.

영문 초록

The Criminal Procedure Act and the Public Prosecutors’ Office Act revised this time have fundamentally adjusted the existing relationship and investigation structure between prosecutors and police. In particular, a system was established to allow victims and other related persons to control police investigations. This heralds a new change in the status of victims. In this paper, the following discussion was conducted in the position that the interests of the victims should be protected in accordance with the purpose of the revised Criminal Procedure Act. First, the nature and function of the complaint were highlighted in the Criminal Procedure Act to clarify the importance of the complaint from the perspective of the victim’s rights. It also predicted the impact of the revised Criminal Procedure Act by reviewing the impact of the investigative agency’s change of authority on the victims’ interests, focusing on the complaint case. Based on this, this paper presented the future tasks necessary to ensure the legal status of the victims.
