제정 수사준칙상 조사·신문·면담 관련 조항에 관한 고찰

국문 초록

형사소송법 개정에 이어 제정 수사준칙이 입법예고 되었고, 이에 대한 찬반논의가 뜨겁다. 하지만 관련 논의는 검·경의 수사권 및 관계, 법령의 소관부처 등에 치우쳐 있는 느낌이다. 제정 수사준칙은 그 외에도 다양한 사항을 규정하고 있으며, 여기에는 조사·신문·면담 절차에 관한 사항이 포함된다. 개정 형사소송법이 피신조서의 본증 요건을 강화함에 따라 신문 국면에 대한 통제가 원활해질 것으로 생각되나, 수사기관의 조사를 받는 사건관계인에는 피의자 외에 피혐의자, 참고인 등도 포함되므로, 그 명칭을 불문하고 수사상 진술청취 절차 전반의 적정화가 필요하다. 이에 본연구는 심야조사, 별건조사, 사전신문 문제를 중심으로 제정 수사준칙상 관련 조항을 검토하고, 각 쟁점에 관한 수사현실과 학계의 논의를 고찰하여, 관련 규정의 개선방안을 제시해 보고자 하였다. 제2장에서는 제정 수사준칙상 관련 조항의 내용과 입법경위를 살피고, 제정 수사준칙이 조사·신문·면담 절차에 관한 사항을 상위 법령에 규정하고 검사 및 사법경찰관 양자를 수범자로 설정한 점, 하위 법령에 규정되어 있던 수범례를 발굴하고 통합한 점 등에 있어 그 의의가 크다는 사실을 확인하였다. 제3장에서는 심야조사, 별건조사, 사전신문 등에 관한 수사현실과 학계의 논의를 일별하고, 수사준칙상 관련 조항의 수정·보완 필요성을 확인하였다. 제4장에서는 이상의 연구를 토대로 심야조사, 별건조사, 사전신문의 규율에 관한 총13건의 개선방안을 제안하고, 조문화(안)을 제시하였다.

영문 초록

According to Criminal Procedure Act amended in 2020, Criminal Investigation Rules have been pre-announced, and vigorous discussions on the rules are pending. However, the discussions are mainly connected with jurisdiction in the investigation and the relationship between prosecutors and senior judicial police officers. There are clauses concerning investigation, interrogation and interview in the Criminal Investigation Rules in 2020 besides jurisdiction in the investigation, etc. As amended Criminal Procedure Act gets into enforcement, control to interrogation phases will be much easier. However, the range of persons involved with investigations is varied from suspects to witnesses, so control to investigative interviewing phases is necessary and important as ever. So this study explored Criminal Investigation Rules in connection with late-night investigation, separate investigation and private interrogation, and contemplated the investigation practices and previous researches about the issues, and suggested the improvement methods. In chapter 2, the contents and circumstances of legislation were explored, and the meaning of Criminal Investigation Rules such as integration fo concerning rules and excavation of model cases were identified. In chapter 3, investigation practices and previous researches about late-night investigation, separate investigation and private interrogation were explored, and the necessity of improvement of Criminal Investigation Rules was identified. In chapter 4, improvement methods which consist of 13 improvement methods of concerning issues were suggested along with provisions.
