국문 초록

자율주행차 운행 중 사고 발생에 따른 형사책임귀속의 주체를 규명하기 위해 운행·운전의 행위자를 특정한 다음 자율주행차의 기술단계별로 형사책임귀속의 주체를 검토하였다. 엄밀히 말하면 현재 자율주행차의 자율주행기술은 자율주행이라기 보다는 운전자 지원시스템에 가깝다고 할 수 있다. 따라서 기존의 운전자 중심의 책임법제를 통해서 형사책임 귀속의 주체를 명확히 할 수 있다. 그러나 레벨4단계와 같이 완전한 자율주행차의 운행 중 사고가 발생한 경우, 그 책임귀속의 주체를 명확히 함에 있어 현행 책임법제를 그대로 적용하기에는 한계가 있다. 국내에서 아직까지 자율주행차 운행 중 사고가 발생하였다는 보도는 없었다. 그러나 미국의 경우 자율주행차의 운행으로 인한 사고가 여럿 발생한 바 있고, 그 중에는 사망사고도 포함되어 있다. 지금처럼 자율주행기술이 급속하게 발전하여 자율주행차가 상용화 된다면 위와 같은 사고가 발생할 것은 자명한 일이며, 그러한 사고들은 기존의 자동차 사고와는 다른 새로운 법적패러다임이 요구된다. 왜냐하면 완전한 자율주행차는 핵심적인 기술인 자율주행시스템이나 인공지능의 오류 등과 같은 원인으로 사고가 발생할 수도 있고 사고원인이 불분명한 경우도 존재할 수 있기 때문이다. 이에 현시점에서 자율주행차와 관련된 형사책임의 문제는 기존의 법체계를 단순 재구성하는 수준을 넘는 근본적인 변화가 필요하다. 한편 인공지능(AI)이 가지고 있는 특성으로 인해 자율주행차와 관련된 법적논의 또한 예측하기 어려운 점이 있다. 그러나 향후 자율주행차 시대의 안정적 운용을 위해 ‘사람’중심의 입법체계에 대한 획기적인 변화가 필요하며 그러한 변화는 ‘인간’ 중심의 법제도가 ‘인공지능’이 포함된 법적패러다임의 전환이 요구된다 할 것이다. 이에 본 연구가 그러한 논의의 시작점이 될 수 있기를 기대해 본다.

영문 초록

So far, the actors of driving have been identified to identify the subject of criminal responsibility due to an accident while driving an autonomous vehicle. In addition, the subject of criminal responsibility was reviewed for each technology level of autonomous vehicles. At present, the autonomous driving technology of autonomous vehicles is not autonomous driving, but a driver assistance system. Therefore, the subject of criminal responsibility can be clarified through the existing driver-centered liability law. However, there is a limit to applying the current liability law as it is in the case of an accident during the operation of an autonomous vehicle, such as Level 4. There have been no reports that an accident occurred while driving an autonomous vehicle in Korea. However, in the United States, there have been several accidents due to the operation of an autonomous vehicle. Among them are deaths. If the autonomous vehicle is commercialized due to the rapid development of an autonomous vehicle technology, it is obvious that the above accident will occur. The accidents require a new legal paradigm that is different from existing car accidents. This is because a complete autonomous vehicle may cause an accident due to errors such as an autonomous driving system and artificial intelligence, or an unclear cause of the accident. Accordingly, the problem of criminal liability related to autonomous vehicles needs to be fundamentally changed beyond the simple reconstruction of the existing legal system. On the other hand, due to the characteristics of artificial intelligence, it is difficult to predict legal discussions related to autonomous vehicles. However, for the stable operation of the era of an autonomous vehicle in the future, a drastic change to the legislative system centered on human is required, and such a change requires the transition of the legal paradigm that includes the human centered legal system and artificial intelligence . something to do. Therefore, we hope that this study will be the starting point for such discussion.
