국문 초록

정보통신기술의 발전으로 주거기능이 확장되고 있으며, 사회적으로 주거에 대한 인식도 변화하고 있다. 기술발전으로 정보이동의 한계가 사라지고, 질병의 사전 예방의 필요성이 강해지면서 주거 내 스마트 헬스케어의 가능성이 커지고 있다. 스마트 헬스케어는 주거 내에서 이루어진다는 점에서 의료행위와의 관계, 스마트 헬스케어 제공자 등이 문제된다. 나아가 주택 내 거주자의 개인정보보호의 문제가 야기된다. 만일 이러한 기존의 법적 규율이 철저하게 준수되는 경우 ‘스마트 헬스케어 주택’의 건설ㆍ공급ㆍ활용 등이 이루어지기는 매우 어렵다. 하지만 사람들은 발전된 스마트 헬스케어를 요청하고 있다. 그것이 기술적으로 가능하게 되는 한 스마트 헬스케어 주택의 건설ㆍ공급 및 확산을 막을 수 없다. 만일, 현행법상의 여러 법적 규율과 스마트 헬스케어 주택의 건설 등이 충돌하게 되는 경우, 단순히 그것을 금지하고 규제하는 것은 최선이 아니다. 즉, 국가는 현상에 맞게 제도를 개선하고 기준을 설정하는 등 새로운 법적 규율의 체계를 수립하여야 한다.

영문 초록

With the development of ICT(information and communication technology), housing functions are expanding, and the perception for housing is also on its way of changing. The technological development enables disappearing of the information transfer limitation, and the necessity of preventing disease in advance becomes stronger, therefore the possibility of smart healthcare in the housing is gradually increasing. Since the smart healthcare is taken place in housing, the relationship with medical practice, and selecting smart healthcare providers, etc. are problematic. Furthermore, the problem of privacy protection of residents in the house would also be caused. If these existing legal rules are followed strictly, it would cause numerous difficulties in constructing, supplying, and utilizing smart healthcare houses . However, the demand for advanced smart healthcare for people are kept increasing. As long as it is technically possible, construction, supplying and proliferation of smart healthcare housing cannot be prevented. If there are conflicts between various current laws and regulations and the construction of smart healthcare houses, simply banning and regulating it cannot be the best option. In other words, the state should establish the new system of legal rules, such as improving the current system and set the standard to meet the current status.
