영국법상 자율주행자동차 보험제도와 그 시사점

국문 초록

정보통신기술의 발달과 더불어 본격적인 자율주행자동차 시대를 맞이하게 되었다. 매년 전 세계적으로 자동차사고로 인한 피해사례가 증가하고 있는 가운데 세계 각국은 자동차사고방지와 피해감소를 위하여 자율주행자동차에 관한 기술개발과 관련 입법을 마련하고 있다. 우리나라의 경우도 2020년 하반기부터 레벨 3 수준의 자율주행자동차 상용화가 이루어질 것으로 예상되는 가운데, 2015년 자동차관리법이 개정되어 자율주행자동차의 개념을 신설하고 자율주행자동차의 시험 연구목적을 위한 임시운행 허가제도가 신설되었다. 또한 자율주행자동차 상용화 촉진 및 지원에 관한 법률(2019년 4월 제정, 2020년 5월 시행)이 제정되어 시행되고 있다. 본고는 자율주행자동차 관련 기술과 법제의 선진국 가운데 하나인 영국이 2018년에 자율주행자동차법을 제정하여 시행하고 있는 것과 관련하여 영국 자율주행자동차법의 내용과 자동차보험제도를 검토하였고 이 법이 우리나라 법제에 주는 시사점을 분석하여 우리나라의 자동차보험관련 법제의 개선방안을 모색하여 보았다. 특히 자율주행자동차의 상용화단계에서 필요한 자동차책임보험제도의 적용확대, 디지털운행기록 저장 및 활용 규정 개선보완, 자율주행자동차 사고와 제조물책임법의 적용 문제 등을 해결할 수 있는 입법적인 개선을 위하여 자동차관리법, 도로교통법 및 자동차손해배상보장법의 개정방안을 제시하였다. 향후 이에 관한 정치한 입법규정 마련을 위한 노력이 필요한 것으로 분석된다.

영문 초록

With the development of information and communication technology, automated vehicles are expected to operate . Around the world, the number of damages caused by car accidents is increasing worldwide, and countries around the world are preparing legislation related to the development of technologies for automated vehicles to prevent and reduce car accidents. In the case of Korea, commercialization of level 3 automated vehicles is expected to begin from the second half of 2020, and the provisions of the 2015 Automobile Management Law were amended to provide the concept of automated vehicles and temporary operation for the purpose of testing research for automated vehicles. In addition, the Act on Promotion and Support of Commercialization of Automated Vehicles has been enacted in April 2019 and implemented in May 2020 . This article analyzes the legislation of the UK Automated Vehicles Act enacted in 2018. UK is one of the advanced countries of autonomous vehicles related technologies and legislation. This paper analyzed the implications and suggested several proposals to improve Korea s related legislation. In particular, this paper suggests that it is necessary to expand the application of the auto liability insurance system required at the commercialization stage of autonomous vehicles, to supplement and improve the regulations for storing and using digital driving records, and to solve the problems of automated vehicle accidents and product liability laws, etc. Further it has been suggested that the amendments to the Road Traffic Act and the Automobile Damage Compensation Act have been proposed, and it is analyzed that more in-depth legislative improvement efforts are needed.
