신종 사이버범죄에 대응하기 위한 법제 정비 방안

국문 초록

신종 사이버범죄에 대응한 법제 정비 방안을 검토하고자 다음과 같이 논의를 진행하였다. 먼저, 사이버범죄의 개념과 관련해서는 기술의 발전과 변화에 따라 유동적일 수 밖에 없다는 점을 지적하였으며, 이를 전제로 사이버범죄의 발생현황을 개략적으로 살펴보았다. 다음으로 사이버범죄의 전통적 특성으로서 초국가성, 전문성, 피해의 광범위성, 익명성과 비대면성 등에 대하여 언급하였으나, 최근의 ‘텔레그램 n번방 사건’이나다크웹에서 발생하는 범죄들을 고려할 때 이들 전통적 특성 중 일부는 발견되지 않는 사례가 늘고 있다는 점을 지적하였다. 그리고 사이버범죄의 구체적 발생유형으로 해킹, 악성프로그램, 자료훼손 및 비밀침해, 사이버 업무방해, 사이버사기 등의 의미와 법률의 정비현황을 검토하였다. 마지막으로 사이버범죄에 대응한 법률의 정비현황과 관련하여 기본적으로 커다란 흠결은 없지만 세부적인 논점에서는 다소간의 흠결이 존재하며, 무엇보다도 일반법인 형법의 경우 신종범죄에 대응하기 위한 입법적 노력이 부족하다는 점을 지적하였다. 그리고 사이버범죄의 경계가 사라지고 있는 상황에서 신종 사이버범죄에 효율적으로 대응하기 위해서는 ① 사이버공간과 오프라인공간에 대한 이분법적 사고의 지양, ② 형법 및 개별･특별법상 구성요건의 정비, ③ 형사절차상 사이버공간에 특유한 수사기법의 도입, ④ 가상화폐규제 및 추적시스템의 개발, ⑤ 기타의 사항(사물인터넷의 위험요소제거, 범죄예방을 위한 신기술의 도입, 전문인력확충) 등에 대한 검토가 필요함을 제시하였다.

영문 초록

The purpose of this study is to review legislative readjustment measures in response to new aspects of cybercrime. To this end, the concept and status of cybercrime that has traditionally been discussed were reviewed (II), and the specific trends and characteristics of cybercrime were outlined (III). It also presented its own ideas on the limitations of the current legal system for responding to cybercrime and the legislative readjustment measures for responding to cybercrime(Ⅳ). First of all, regarding the concept of cybercrime, pointed out that it has to be fluid as technology advances and changes, and looked at the current status of cybercrime on the premise of this. Next, it mentioned transnationality, professionalism, extensive damage, anonymity and non-face-to-face as traditional characteristics of cybercrime, but pointed out that some of these traditional characteristics are not found in light of recent “telegram incidents” or crimes occurring on the Dark Web. Also, examined the meaning of hacking, malware, data destruction, and confidential infringement, cyber business obstruction, cyber fraud, and legislative maintenance status as specific types of cyber crimes. Finally, regarding the current status of legislative reform in response to cybercrime, it was pointed out that there are some flaws in the basic legal readjustment status, but there are some flaws in the detailed argauments, and above all, no legislative effort can be found to counter new cyber crimes in Korean criminal law. And in order to effectively respond to new cyber crime in the event that the boundary of cyber crime is disappearing, It is necessary to consider the following: ① avoidance of dichotomous thinking in cyber space and offline space, ② improvement of criminal law and special law, ③ introduction of investigation techniques specific to cyber space, ④ development of virtual currency regulation and tracking system, ⑤ other matters (the removal of risks of the Internet of things, the introduction of new technologies to prevent crime etc).
