경제범죄에 대한 새로운 정책적 대응방안

국문 초록

경제질서를 교란하고 개인 뿐만 아니라 사회적으로 막대한 경제적 손실을 가져오는 경제범죄에 대한 대응방안으로 2001년과 2012년부터 시행되어 온 법준수프로그램(Compliance Program)의 하나인 준법감시인과 준법지원인제도, 그리고 2009.7.1.부터시행된 횡령·배임범죄 양형기준 등이 제도적 장치로 마련되어 있음에도 여전히 경제범죄에 대한 형사적 제재로는 미흡하며 그 효과성에 대해서도 비판이 제기되고 있다. 특히 기업에 의해 범해지는 경제범죄의 경우 양형기준이 권고적 효력에 그치는점 때문에 집행유예가 선고되어 국민적인 비난과 더불어 사법에 대한 불신마저 가져오고 있는 실정이다. 본 논문에서는 경제범죄에 대한 효율적인 대응방안으로 공익기부금 납부나 공익시설의 설치 등을 사회봉사명령의 하나로 도입하는 방안을 제시해 보고자 한다. 즉행위자의 사회적 책임을 구체화하고 처벌과정 속에 사회를 편입시키고자 하는 상징적 원상회복의 관점에서 사회봉사명령을 바라본다면 경제범죄로 인하여 야기된 법익침해의 영역에 따라서는 그러한 침해를 예방하는 사회적 장치를 마련하는 공익시설의 설치 등을 위한 기부금 납부의 형태도 현행과 같은 공익시설에서의 근로봉사와마찬가지의 성격으로 이해할 수 있다. 그리고 기업에 의하여 저질러지는 경제범죄를 효과적으로 통제할 수 있는 방안의하나로 직접행위자 뿐만 아니라 이를 지휘·감독할 책임이 있는 기업의 대표자, 임원등 기업의 계층구조상 상위에 있는 경영자의 책임을 물을 수 있는 입법적 방안도 강구될 필요가 있으며, 기업 자체에 보호관찰이나 영업금지 등과 같은 보안처분제도의도입을 통하여 실질적인 통제가 이루어지도록 해야 할 것이다. 나아가 경제범죄로 인한 수익을 국가가 몰수 또는 추징하는 방안의 효과성에 대해서도 비판이 제기되고 있는 만큼, 경제범죄로부터 취득한 이익의 박탈과 더불어 피해회복 및 사회에 대한 속죄라는 관점에서 원상회복처분을 경제범죄에 대한 독립적 형사제재로 도입하는 방안에 대해서도 고려해 볼 필요가 있다.

영문 초록

Distract bring economic losses to individuals and society as a countermeasurefor economic crimes, respectively, in 2001 and implemented from 2012 onwardshave been Compliance Officer and Compliance Support System and ComplianceProgram. 01.07.2009 effective from embezzlement, breach of trust criminalsentencing standards in place institutional arrangements, despite the criminalsanctions for economic crimes criticized the lack of effectiveness. In particular, theorganization of economic crime in the quantification of punishment sentenced toprobation because of enforceable standards are national criticism and confidencein the judiciary dropped. In this paper intends to show the installation of public institutions such aspublic donations to pay or plan to introduce community service as one of theeffective countermeasures for economic crimes. Materialize and the actors of socialresponsibility from the perspective of symbolic restitution, the form of donations topay for the installation of public service facilities, such as the true nature of theservice and working in public institutions, such as the current and can beunderstood. And there is also a need to recognize the actors as actors, as well asmeasures to economic crime can be effectively controlled by a corporationresponsible for overseeing management s responsibility. And practical control bythe corporation itself, such as probation or a sales ban on the introduction ofsecure disposal should be conducted. Furthermore, forfeiture or impose measures the effectiveness of the nationalrevenue due to economic crimes is also criticized as, to take away the gains fromeconomic crime, there is a need to consider a plan for recovery and social responsibility in terms of the introduction of the independent criminal sanctions foreconomic crimes, restitution disposal damage.
