보육교사의 근로조건 개선을 위한 관련법 검토

국문 초록

최근 어린이집에서 발생한 아동학대 사건은 보육시설에 대한 부모들의 불안감을 증대시켰다. 정부는 부모들의 불안감을 해소하는 방법으로 2015년 「영유아보육법」을 개정하였고 모든 어린이집에 폐쇄회로 텔레비전 설치를 의무화하였다. 그러나 어린이집에서 발생하는 아동학대를 예방하는데 폐쇄회로 텔레비전의 설치만으로 충분할 수 없을 것이다. 대개의 돌봄 노동의 특징에 나타나는 바와 같이 영유아를 대상으로 돌봄과 교육을제공하는 보육의 질은 종사자가 어떤 상황에서 돌봄을 제공하느냐에 따라 직접적으로좌우된다. 그럼에도 불구하고 현재 어린이집의 보육의 질을 향상시키는 문제와 관련된논의의 상당부분은 폐쇄회로 텔레비전의 설치와 관련된 것과 보육교사 양성을 엄격하게 해야 한다는 부분에 집중되어 있다. 그러나 어린이집에서 제공되는 보육의 질을 향상시키기 위한 가장 기본적인 전제는보육교사의 인권이 보장되는 근로조건이 확보되어야 할 것이다. 이 연구는 보육교사의근로 현실과 관련된 법을 검토하여 이 법이 보육교사들의 근로 현실을 고려하여 이들의 인권을 보장하기에 적절한 역할을 하고 있는지 검토하고 있다. 특히 보육은 유아에 대한 돌봄과 교육의 특성을 모두 가지고 있기 때문에 아동에 대한 양육의 1차적인 책임을 부담하는 부모와 그 역할이 적절하게 분담될 때 이상적인 보육의 질이 유지될 수 있다. 따라서 보육과정에 부모와의 관계 설정의 균형이 적절하게구성되었는지 살펴본다. 또한 2015년부터 도입된 폐쇄회로 텔레비전을 통한 영상촬영과정에 보육교사의 개인정보 보호가 적절하게 이루어지도록 법이 구성되어 있는지 검토하고 보육의 질이 보장되는 전제로서 보육교사를 둘러싼 법과 정책의 어떤 부분이개선되어야 할지 제안하고 있다.

영문 초록

Recently, the child abuse which has arisen in daycare center causes parent s anxiety about nursery facilities. To abolish the anxiety the government revised 「Infant Care Act」 and make it mandatory that all of nursery facilities install a closed-circuit television (=CCTV). However to prevent the child abuse case which has arisen in daycare center, installing CCTV is not enough. Generally, as like the quality of care depends on the working conditions of the care givers, the quality of infant s care and education is influenced by nursing teacher s working conditions. Nevertheless, the discussions about improving the quality of infant s care and education focus on installing CCTV and strict training nursing teachers. The most important premise to improve the quality of the infant s care and education is that the nursing teachers working condition should be properly arranged from the aspect working hour, labor intensity, and the work scope. This paper deals with that the policies and acts related with the working condition of the nursing teachers are properly organized to protect their human right. Especially, nursing teacher and parents share the responsibilities for care and education to the infants, therefore its ideal quality could be maintained when parents and nursing teachers role is clearly divided and in doing so, there is no blind spot. So this paper examines whether responsibility for infants care and education between parents and nursing teachers is properly divided. Furthermore, because of installing CCTV in every daycare center from 2015, the 「Infant Care Act」 and 「Act on the Protection of Personal Information」 are properly regulated to protect privacy of nursing teacher
