국문 초록

보험금청구권신탁은 생명보험계약상의 사망보험금청구권을 신탁재산으로 하는 신탁이다. 미국과 일본에서는 이미 유족의 생활 보호 등을 목적으로 활용되어 왔다. 국내에서는 최근 이에 대한 논의가 시작되었으나, 아직 활발한 수준은 아니다. 급격한 고령화에 따라 생명보험금과 관련한 재산관리를 통한 유족생활보호의 필요성 및 후견제도와의 결합을 통한 피후견인의 재산의 장기적, 체계적 관리 필요성이 증대되었고, 이에 따라 국내에도 보험금청구권신탁에 대한 논의를 활성화하고 이를 도입할 필요성이 크다. 본 논문에서는 보험금청구권신탁의 개념과 필요성, 미국과 일본에서의 보험금청구권신탁 활용 사례와 그에 따른 보험금청구권신탁의 유형에 대하여 살펴보고, 현행법의 해석 하에서 보험금청구권신탁의 도입이 가능한지 및 가능한 유형에 대하여 논의한다. 그리고 보험금청구권신탁의 경우 보험수익자 법리의 신탁수익자에 대한 적용 가능성, 유류분 등 상속법과의 관계, 소멸시효 완성 방지를 위한 장치, 보험계약과 관련된 보험금청구권신탁의 종료사유 명확화, 보험금청구권신탁 상품을 실제로 판매할 때 및 보험회사가 수탁자를 겸하는 경우 유의사항에 대해서 검토한다.

영문 초록

The trust of life insurance claim means a trust in which a policyholder of life insurance, i.e. settlor, entrusts with a trustee his/her right to claim for life insurance proceeds. In the U.S. and Japan, the life insurance trust has been utilized to protect livelihood of family of the deceased. Discussion on the trust of life insurance claim has recently started in Korea, but it is still in its infancy. As the Korean society is rapidly aging, it is increasingly necessary to support the livelihood of the bereaved by managing assets related to life insurance proceeds and to combine the trust with guardianship so that the long-term assets of a ward can be methodically managed. In view of the foregoing, the author believes that proactive discussion on the trust of life insurance claim should be aimed in Korea as well. In this article, the author will address the notion and necessity of life insurance trust and relevant cases in the U.S. and Japan, thereby categorizing the type of the trust of life insurance claim. Then, there will be discussion on whether the trust can be introduced under the current domestic laws and, if applicable, explanation of each plausible case. This article also aims to cover some legal issues on whether legal principles applied to insurance beneficiary would be applied to the entrusted beneficiary in the life insurance trust, statute of limitations, and reserved portion. The author argues that discussion and improvement of the relevant system should be made to sell and spread the trust of right to insurance claim in practice.
