대여자동차 운행시 대리운전의 보험법적 보호에 관한 고찰

국문 초록

일상생활에서 불가피하게 대리운전을 이용하는 경우가 많아지고 있다. 대리운전 중 발생한 사고에 대하여 보상 문제가 야기되었고, 이에 따라 관련 보험 상품이 개발되고, 관련 보험약관은 수차례 개정이 되었다. 이와 같은 개정 및 보험의 개발은 피해자의 보호 뿐 아니라 차주 그리고 대리운전자의 보호를 위함이었다. 자동차보유자의 약관이 변경되고, 특약을 가입하여 대리운전 중 사고를 자동차보유자의 보험에서 담보할 수 있게 되었고, 대리운전 보험이 개발 및 판매되어 책임보험금의 초과하는 손해를 담보할 수 있게 되었다. 다만 대여자동차의 경우 기명피보험자의 의사를 기준으로 하여 피보험자를 판단하게 되는데, 임차인의 승낙을 얻고 운전한 대리운전자는 대여자동차 보험의 피보험자로 포섭될 수 없어, 대리운전자가 대리운전보험을 가입하더라도 책임보험금에 상당하는 손해를 부담하게 되는 불합리함이 발생되고 있다. 대여자동차 시장이 장기 렌트, 단기 렌트 형태로 다변화되고 시장이 커지면서, 대여 자동차 운전 중 보상 문제에 대한 문제가 야기되고 있다. 대리운전자는 대리운전 중 사고로 인한 손해를 담보하기 위하여 계약을 체결했음에도 대여자동차의 경우 책임보험상당액은 보험으로 담보되지 않고 있다. 이와 관련하여 대리운전의 현황, 보험의 체계, 관련 판례 등을 살펴보고자 한다.

영문 초록

Designated driving serviceA car driving service when a driver is not in condition for driving, especially due to DUI(Driving Under the Influence). has become common in daily life. Compensation problem has arisen for accidents that occurred during designated driving. As a result, relevant insurance products have been developed, and relevant insurance terms have been revised several times. Such amendments and insurance developments were intended not only to protect victims but also to protect car owners and designated drivers. The terms of car insurance has been changed, and special contract terms can be added to cover the accidents during designated driving, and the insurance for the designated drivers has been developed and sold to cover excess damages over liability insurance. However, in the case of rental cars, the insured is decided based on the intention of the named insured. A designated driver who has obtained the consent of a rentee of the car cannot be considered as an insured in terms of the rental car insurance. Therefore, there has been an issue of irrationality that a designated driver should compensate the excess damages over liability insurance on its own in spite of the insurance for the designated drivers. As the rental car market has been diversified into long-term and short-term rentals, and the market has been growing, there has been a problem when it comes to compensations while driving a rental car. Although the designated driver signed a contract to cover damages caused by an accident during designated driving, liability insurance is not covered by insurance in the case of rented cars. In this regard, we will look into the current status of designated driving, insurance system, and the related cases.
