성년후견제도 활성화 방안에 관한 소고

국문 초록

작년에 제5회 세계성년후견대회에서 후견 관련 법제도를 개편할 수 있도록 범정부차원의 입법추진기구를 발족시킬 것을 촉구하는 서울선언이 채택되었다. 아직 그러한 입법추진기구가 발족되지는 않았지만, 초고령사회에 대비하기 위하여 현재의 후견제도가 개선이 필요하다는 공통된 합의점은 도출한 것으로 보여진다. 유엔 장애인권리위원회에서 권고하는 성년후견제도 개선 방향은 의사결정능력이 부족하거나 결여된 자의 의사를 후견인이 대행하는 것이 아니라 그들의 의사를 최우선으로 하여 의사결정을 조력하는 것이다. 이를 위하여 발의된 ‘후견 등 의사결정지원에 관한 기본법’이 후견제도를 필요로 하는 많은 사람들이 쉽고 적극적으로 이용할 수 있는 역할을 할 수 있도록 수정될 필요가 있다. 그리고 이용률이 저조한 성년후견제도를 활성화시키기 위하여 성인발달장애인과 치매환자에 한정시켜 제공하는 공공후견의 대상을 의사결정능력에 장애가 있는 성인으로 확대하고, 특정후견에 한정하여 제공하는 후견유형을 확장하여 후견이 필요한 자에게 국가가 후견서비스를 제공하도록 해야 한다. 이에 더하여 법정후견보다 현저히 이용률이 미미하지만, 피후견인의 의사를 가장 존중할 수 있는 이상적인 제도인 임의후견을 활성화시킬 수 있도록 후견계약의 체결방식을 간소화시키고, 당사자가 구체적인 계약내용을 쉽게 확정할 수 있는 표준후견계약서 양식을 제공하도록 한다.

영문 초록

Last year, the Seoul Declaration was adopted at the 5th World Congress on Adult Guardianship, calling for the launch of a pan-government legislative body to revamp the guardian-related legal system. Although such a legislative body has not yet been launched, a common consensus seems to have been reached that the current adult guardianship system needs improvement to prepare for a super-aged society. The U.N. Commission on the Rights of Persons with Disabilities recommends that the direction for improvement of the adult guardianship system is to assist in decision-making, not to replace the will of those who lack or lack the ability to make decisions, but to put their will first. To this end, the proposed Basic Act on the Supported Decision-making needs to be modified to play an easy and active role for many people in need of the adult guardianship system. In order to activate the underutilized adult guardianship system, the government should expand the scope of public guardianship system and the type of guardianship. In addition, although the utilization rate is significantly less than that of the legal guardian, the method of signing the guardianship contract, an ideal system to respect the will of a ward, is simplified to activate the use of the adult guardianship system, and the party is provided with a standard guardian contract form that allows the party to easily make the details of the contract.
