국문 초록

남북의 경제발전을 촉진하는 남북경제협력에 대한 관심이 높아지고 있다. 자립국가경제를 강화하면서 다른 국가들과의 경제협력을 강화하는 것은 북한 정권의 일관된 정책이다. 현재까지도 남북경제협력은 좌초된 반면, 북한은 대외경제정책(예를 들어, 금강산 국제관광특구, 경제개발구 등)을 대폭 변경하였다. 북한은 외국투자가의 이익을 보장하는 한편 정부, 투자가, 기업과의 교류와 협력을 활성화하는 데 깊은 관심을 기울이고 있다. 특수경제지대의 지정과 투자유치에 대한 북한의 정책은 남북경제협력의 전망을 결정하는 핵심 요소에 해당한다고 볼 수 있다. 이 글은 북한 정권의 대외경제정책과 함께 외국인투자관계법제를 이해하고 분석하는 것을 목적으로 하고 있다. 이 글의 주요 내용은 투자보장을 중심으로 북한의 외국인투자관계법제를 살펴보고, 주요한 대외경제법제를 비교법적으로 분석하는 것이다. 이와 함께 남한과 북한 사이에 보다 더 나은 경제교류와 협력을 위한 차원에서 내국민대우와 초국민대우, 안보 등 투자보장의 예외조치, 숨은 규제 해소, 국제규범의 국내법화 등 북한의 법제적 변화 전망과 제언을 하고 있다.

영문 초록

There is a growing interest in inter-Korean economic cooperation that propel North and South Korea’s economic development. It is a consistent policy of the North Korean Government to enhance economic cooperation with other countries, while beefing up its self-reliant national economy. The inter-Korean economic cooperation was held in abeyance while the North Korea made significant changes in its external economic policy, e.g., MT. Kumgang Special Zone for International Tourism and Economic Development Parks etc. The North Korea pay deep attention to ensuring the interests of foreign investors, while invigorating the exchange and cooperation with governments, investors and businesses. The North Korea’s Policies on designation and investment attraction of special economic zones can be core factors that determine the projection of inter-Korean economic cooperation. This article is aimed at understanding and analysing legislation on North Korean foreign investments with government external economic policy. The main contents of this article include charactors of legislation on North Korean foreign investments focused on investment promotions and protections and comparative analysis of the relevant external economic legislations. In parallel, the author would like to submit prospects and proposals of changes in North Korean’s foreign investment legislation for better economic exchange and cooperation between North and South Korea, e.g., national and transnational treatment, security exceptions, shadow regulation settlement, domestic law of international norms, etc.
