국문 초록

북한 민사법은 인간의 존엄과 독자성을 인정치 아니하고, 사회주의 대가정을 내세워 수령이 북한전체의 가장이라는 북한주민의 자연적이고 인격적인 존엄한 존재로서의 인간을 인정치 않고 있다. 북한의 민사법은 이러한 사회주의와 주체사상의 실천을 위한 수단으로서의 법이다. 통일이 이루어지기까지 사회주의 북한민사법은 인류보편의 가치를 실천하는 민사법으로의 변화가 있을 것을 기대한다. 또한 북한민사법이 인간의 존엄과 자유와 평등을 인정하고 시장경제를 실천하는 법으로 변화해 나갈 것을 기대한다. 그리하여 남북한이 통일이 되었을 때의 통일 한국민법은 인류의 영원한 보편가치를 실현하는 내용으로 구성된 민사법이 되어야 한다. 인류보편의 가치를 이상과 목표로, 그것이 실현가능할 수 있도록 우리 민법도 북한 민법도 계속적인 변화와 승화가 있기를 소망하고 기대한다.

영문 초록

North-Korea is a collectivistic political regime embodied with orthodox socialism and self-reliance (Juche) ideology. North-Korean civil law does not recognize human dignity and individuality of natural person, and it recognizes ‘Suryŏng’ as the head of the entire North-Korean society. The civil law in North-Korea is a kind of means for the practice of socialism and ‘Juche’ ideology. Until unification, the socialistic North-Korean civil law is expected to be progressed into the civil law that shall realize the values of universal values. It is also hoped that the North-Korean civil law could be transformed into the law that recognizes human dignity, freedom and equality and practices the market economy. Thus, when the two Koreas would be unified, the new Korean civil law shall be compiled with contents that realize the eternal universal value of mankind. I hope and expect that the civil law of South- and North-Korea could continue to be changed and to be sublimated for realization of the ideals and goals of universal human values. Ultimately it is thought that justice and love shall be basic universal values to be realized in the new Korean civil law after unification.
