국문 초록

지적재조사 사업으로 인해 토지이동이 있게 되면 지적소관청은 새로운 지적공부를 작성하고 관할 등기소에 등기촉탁을 하게 된다. 그리고 이 때 행해지는 등기는 등기부 표제부에 하는 부동산표시에 관한 변경등기로서 ‘사실의 등기’에 해당한다. 이와 같은 ‘사실의 등기’는 ‘권리의 등기’가 아니므로 지적재조사에 의한 토지이동시 물권변동의 효력은 발생하지 않는다고 한다. 그러나 부동산표시에 관한 변경등기는 변경등기 전·후 토지사이에 동일성이 있는 경우에 인정되는 것으로서 지적재조사에 의한 경계변경으로 토지의 면적증감이 상당한 경우에도 지적재조사 전·후 양 토지사이에 동일성이 존재하는지는 의문이다. 만약 지적재조사 전·후 양토지 사이에 동일성이 존재하지 않는다면 물권변동을 인정하여야 할 것이다. 본 연구는 이와 같은 의문에서 출발하여 대법원판례 및 관련 법률을 살펴봄으로써 지적재조사에 의한 토지이동시 물권변동의 성립여부를 검토하였다.

영문 초록

When there is land alteration due to the cadastral resurvey, cadastral authority makes a new official cadastral record and requests its registration to the competent registry office. The registration made at this time corresponds to the registration of status as registration of change on the indication of real estate made in a heading of the register. Since the registration of status is not the registration of rights, it is said that there is no change in a real right in the case of cadastral resurvey. However, registration of change on the indication of real estate is recognized when there is the sameness between the lands before and after the registration of change. Therefore it is doubtful whether the sameness exists between the two lands before and after the cadastral resurvey, even if the change in the size of land is significant due to the change in land boundary made by cadastral resurvey. If there is no sameness between the lands before and after the cadastral resurvey, it is necessary to admit the change in a real right. Starting from this question, this paper examines the establishment of change in a real right when there is land alteration due to the cadastral resurvey by reviewing Supreme Court cases and related laws.
